Tier 4 (Child) Visa

Hello Everyone,

I was in UK from Sept 2005 to Jan 2009 on Student visa along with my family (my wife and daughter). In September 2008, my son was born in Leicester (UK) but due to some family issues i returned back to my home country (India) in January 2009, though we had a valid visa till the month of May 2009.

I have no negative remarks nor i have overstayed in UK. I have even visited UK again in the year 2012 on Business Visa through my company in India were I was working as an International Marketing Manager and I return back to India within 5 days after my official meeting in London.

Currently, I am in Tbilisi, Georgia on work visa along with my family. but school education is pathetic here and i am desperately looking forward to move to UK along with my family on basis of my child education in private school (5th grade) through Tier 4 (child) visa scheme.

I have checked that in general condition, dependent parents are not allowed for paid work but have also collected some information that dependent parents of child under age of 16 born in UK are allowed to work.

Please let me know if my information is correct and advice me with the best of knowledge and information that you have, so as take some concrete decision ahead on base of your information provided.

I don't know what information you are looking at, but there is no such visa as dependant of a Tier 4 (Child). Moreover, no type of visa of any kind allows a parent to be a dependant.

You must be thinking of the Parent of a Tier 4 child visa, but this does not allow a family to move to the UK. See https://www.gov.uk/parent-of-a-child-at-school-visa where it explains

You can’t:

* switch into a different immigration category from a ‘Parent of a Tier 4 child visa’ when it expires
* get public funds
* make your main home in the UK
* take paid work
* study
* bring other family members (‘dependants’) with you on your application - they must apply separately
