My MP said I should contact him after 6 months if the Home Office do not make a decision.

So am really worried and thinking about asking to get back my wife’s passport in other to apply for her to come to Italy.
Dont quit now, wait till January 28, that would make it 6 months. Again you are not living in Italy now, how sure are you that the Italian Visa will be quicker, I heard that schengen visas take long now in Naija. I thought about doing same when my wife's first refusal came, but later decided to reply and see.

We submitted the application on the 28 July 2017 with all the necessary documentation required.
try and contact your MP, i did same and the MP called them few times and the hurried them up, although they refused the visa due to not submitting my bank statement. by my wife has since reapplied over a month ago, still waiting. the first application was on the 6th of July. she applied in Abuja. their processing time has been reduced for applications processed in November.

I do not know if Dokie, another guy on this forum whose wife applied also from Nigeria has received a decision yet.
Hello,
I applied from Abuja. No news yet.q
I contacted MP and SOLVIT. Still no news. Hopefully in the new year,
Happy new year in advance

Hey guys,
I am still impatiently waiting, today makes it 113 working days.
Looking like a punishment is being meted on Applications from Nigeria.
We just have to continue praying and I know we all will have our testimonies soonest.
Do enjoy the rest of the year and a happy new year in advance.
Cheers!

Hello,
I'm not sure anyone has news fro naija apart from the one that was refused earlier.
It's a bit frustrating but what can we do!
They've held my passport since July21, I've called 3 times and it's the same old story.
I wish I could sleep and wake up when this nightmare is over. This is my worst Christmas ever. I spent most of the day consoling a crying wifey. Guyz u don't want to know. However. I won't stop believing. Sometimes I wonder what they checking? Probably my grandfathers grave and my ancestors grave. I've read on this. Forum someone got it it 13 working days last month and it's taken 113 days for me and much more for some others.
Waiting close to 6 months for. 6 months visa haba? ( pardon my naija mannerisms) how long will it take to get the residence card of 4.5years? Another 4.5 years waiting time?
I will stop ranting now and see how long it's going to take?
Once again happy new year to everyone waiting and NEVER STOP BELIEVING

I applied in Madrid in mid August... ... After 4 months and a half i got an email today saying that my application has been assessed and that in the next few days they will contact me to pick it up.

Those are great news, i will know the outcome shortly.

Fingers crossed

It's bloody frustrating but can I can only laugh pray and hope for the best. They have all my details and I don't think there's much to investigate
To everyone that have just received their FP
Once again congratulations. Enjoy your time with family. Hopefully soon, we will share our good news with you all.

Another question is what is the difference if applying for Residence Card holding a FP or without one.
The difference is that the facts have already been investigated when a FP is granted. The courts have held that it is inappropriate to reassess the facts when such an assessment has already been made.

I think they should issue a FP on the border passing if all the documents are alright. Does someone know something about that? Why do people go by ground and get the FP and not the airport? There should apply the same rules on border passing.
The difference is that UK law does not apply to French or Belgian port authorities - the port authorities cannot be fined for allowing people to reach the UK immigration officers. EU law applies to the actions of UK immigration officers. The reason some people need a family permit is that airlines and ferry companies can be fined if people reach UK Immigration with what are considered 'adequate' documents.

Please don’t make confusion about this. I am Spanish and my husband is here in Spain with spanish residence. He try travel WITH ME to London and police on airport denied to enter because my husband NOT HAS A VISA. So, that information is irrelevant, he can try enter but sure 99% possibilities to not enter in England.
If your husband were refused entry at Gatwick airport, that sounds unlawful. They cannot lawfully refuse him entry merely for lack of a visa if you two could prove that you were Spanish and that you two were married. There has to be a further reason to refuse him entry.

Refer to this link:

https://www.gov.uk/government/publicati ... dence-card

"If you are a non-EEA national who holds a valid genuine residence card, issued to you as the family member of an EEA national who is exercising free movement rights in another EEA State (i.e. not your EEA relative’s Member State of nationality) under Article 10 of Directive 2004/38/EC (the ‘Free Movement Directive’), you may use this document for travel to the UK if you are accompanying your EEA national relative here, or joining your EEA national relative in the UK."

EEA FP timeline 2017

Post by ledrox » Sat Dec 30, 2017 10:03 am

Only way I found to estimate timeline for EEA FP and in my case (from New York USA) it was accurare is:
  • Follow the instructions and select the visa category you would like to see processing times for "Other Non Settlement Visa" (if available)
  • Finally Family permit
e.g.

From Spain Madrid get a EEA Family permit most applications (85%) are processed within 4 months

From the USA New York all the applications (100%) are processed within 15 days

Athens, Greece most applications (96%) are processed within 15 days

Mumbai, India some applications (56%) are processed within 4 months

if there isn't an option to see EEA Family permit processing time it is probably because statistics are incorporated with other VISA or no data is available/recorded

Hope this is useful!
Good luck everyone!

Hi All Nigerian Applicants

My brother-in-law (married to my sister; he is spanish and my sister has UK Residence Card) first applied for EEA FP for my mum 23 June from Ikeja, Lagos. That application got refused and they appealed it.

However, They decided to put in another application; but, this time from Abuja on the 11 October, 2017.

Not Straightforward: 27/10/17

They have not heard anything from them since then. My mum has been dependent on them since mid 2016.

How could your mum put in another application while her case is in the court. I guess that they may certainly suspend her second application, pending the outcome of her appeal. It looks understandable that the two cannot work concurrently.

Hi Ola

The law governing EU nationals and family members as per Free Movement Right is Immigration (European Economic Area) Regulations 2016 as amended and NOT UK Immigration Rules. Hence, it is permissible to challenge your refusal while still putting in fresh application.

This means you can challenge your refusal and, at the same time, make fresh application. They are not mutually exclusive.

However, under UK Immigration Rules it is impossible!

Feel free to get in touch or ask the experts we have here.
