What is your partner's nationality? In any event it will seem that the advise you were given in relation to permanent residence is clearly wrong.

Hi obie thank you for reply. My partner is Spanish and child Spanish too. Someone said if I apply eea fm based on EU child would be easier to get uk residency. He said to me that I can apply PR after 5 years too. He said don't apply through your partner. I seeking best advice please . Because I have toeic issue.

Hi obie we are not married . We are I durable relationship. My child is 2 years born in UK. But we are almost 5 months in outside UK. I have only UK and outside UK cohabitation proof 2 years together .

The advise you were given is wholly misconceived.
You cannot qualify on the basis of the child if you have the mother around.
Perhaps you may qualify as durable partner. Maybe you can consider getting married.

Ok obie. If I apply unmarried partner visa in UK. Will they count UK 1 year and outside UK 1 year as 2 year cohabitation proof together or not???? Can I overcome toeic based on eea unmarried application?? I already lost toeic JR due to dodgy lawyer .

That is a shame. The irony is you appear to be still getting the dodgy advise.
Yes you can combine period of cohabitation from different country.

Unfortunately you should have applied based on your family before you left the UK, rather than going.
