Hi All,

i really need your help. pleaseeeeeeeeee replyyyyyyyyyyy

i have received SAR report and i found a paper called SEARCH SUMMARY REPORT

it has got all the dates when my application was raised. it states in there that

date app raised Category OUTCOME
28 Oct 2010 tier 4 reject
14 Nov 2010 tier 4 refuse L.T.R - NO R.O.A
22 Jan 2011 TIER 4 GRANT LTR
20 july 2011 Tier 1Grant LTR
15 july 2013 Tier 2 Grant LTR
10 july 2016 Tier 2 Grant LTR

firstly i would like to tell you about my case, i arrived in uk 4 july 2007 on student visa which expired on 30/10/2010. as per SAR 1st application on 28.10.2010 was rejected due to incomplete application , 15.11.2010 application was rejected due to more than 30 days old bank statement .

My question is, due to rejection and refusal in 2010, did i violate 3C or is there any gap?? or over stayed?/

i would really appreciate all of you guys help especially the guru's admins

Thanks in advance!!!!

Hi Experts,

I need some guidance on my ILR. I am in a very difficult situation . I am on a ICT Tier-2 visa and first landed in UK in July 2008 on a Work Permit. There after my employer sent me back to India in Dec 2012 and my new visas were issued in March 2013 with a gap of more than 28 days from the previous visa. So my clock started again. However, I will be completing 9.8 years in February 2018 and will be short of 4 months for ILR.

I met few solicitors and they said that in this situation, I should apply for ILR via Post in Feb 2018. As per them, the Home office will usually take 5-6 months to process my application and by that time, I would have completed my 10 years and will get ILR.

It is not that I do not trust my solicitor but wanted to know your thoughts and opinion.

1. Will the postal application work in my case and be considered?
2. Can I legally work during this period?
3. Is the 28 day gap between two visas applicable for a 10 year route ILR?
4. Anything that I should be aware off?
5. Is FLRO visa an option?

Sorry for so many questions but I am very confused at the moment. Your help will be much appreciated.

Thanks
Mansoor
Hi Mansoor
Although I could not answer all your question, I can answer a few of them according to my experience and what I have known.

Can I legally work during this period?
Yes you can as per their rule, when you submit an application, whatever visa you were currently on will remain valid during your application progress until decision is made.

Is the 28 day gap between two visas applicable for a 10 year route ILR?
This should not affect your continuous residence. You should only have worried about 28 days if you were renewing visa from inside UK and would be considered an overstayer if you stayed in uk for more than 28 days or submitted an application after 28 days after the expiry of your visa . The continuous chain would have been broken if you had been outisde the UK more than 6 months at one time or spend 18 months outside the UK throughout the whole 10 year period.

That is all I can tell you for now. Good luck mate.

If you post your question in its own thread there are chances of getting answer. Also, provide all the details including your immigration history since you've come to the UK. Why your application was not decided on the same day? etc

Hi Ali
Ive read ur story i think u will not hear from home office anytime as ur appeal was never allowed in the past and then u withdraw ur appeal for ILR so that mean judge have never gave decesion in ur favour . now home office is investigating ur application for deception as u been detained in the past and they curtailed ur leave to remain .So long story short to home office u have never spent ur time in UK legally and for them ur marriage was fake or sham marriage. I dont think they will give u ILR or anyother leave to remain as ur case is falling in deception u still have a long battle with home office . U still have to prove to them that ur marriage was geniune. I think they will refuse ur ILR and they might not give u right to appeal again u have to go for JR. I might be wrong but thats what i think after reading ur history.

Hi
I wanted to share my experience to get ILR on the basis of 10 years you can have benefit from my experience.

Category: Tier 1 Entrepreneur To ILR
Number of dependents: 0
Tot. cost: £2887
PEO branch: Croydon
Documents provided:
Old Passports
Current Passport
BRP cards 1
Application form (1)
Appointment letter
Payment letter
Photographs 2
3 months bank statement personal
Life in the UK test (1)
UK Degree
Marriage Certificate (1) and birth certificate for dependent
Accountant Letter from Registered Accountant
Company information like current appointment reports
Company bank statements for 2 years
Paye statements for 1 year
Business contracts but I only provided one.
Company Accounts for last 3 years plus corporation tax but I did not provide them .

Keep all the business related documents but don’t provide all as they will ask if they need more. Keep the file as simple as possible. Went in at 10:00hrs, out at 15:00

No questions asked and after 5 hours they called me to collect the documents and told me that application was successful.

No need to hire any lawyer .
But Accountant is very important
Accountant letter should state following stuff.

1) When the investment was made as a director Loan
2) How many emoloyees and how many hours they do and pay rate
3) Tax details and company profit or loss for all the years .
Special thanks to Saxena for the details.
Regards
Raheel

Hello
I have given the full details of all the documents because these are the documents which are needed for extension of Tier 1 ENT. So they can’t ask more documents plus they don’t bother much as this is ten year route but it’s better to get all the business related documents . Make the same accountant letter which I mentioned.

Bro Bhatti please make all the documents which I mentioned , you don’t need anything else. They just wanted to see that your business is up and running as this is not Tier 1 ent extension. But you can take extra if you have there is no harm in it . Plus if you wanna speak I don’t know what are the rules here for contact. Just check with admin so you can get my email or phone number .

Thanks a lot raheel ,
It is very good info . I have managed to get all these documents . Did u submit any covering lette with ? Everyone says , even in this forum too , to submit only required documents rather that submitting business related documents . It is true too . But even now I'm thinking to submit all the business related documents too .

I dont know the exact rules of this forum regarding sharing phone numbers , otherwise I would also asked .

Anyway thanks a lot brother . I really appreciate ur sharing mentality even after ur approval .

Raheel congrats on your ILR. I'm in the same situation as you.

Just a couple of questions please. Were in the first part of your visa (3 years) or the extension part? When was your Tier 1 entrepreneur approved?

Did you provide your business related documents in the beginning of the appointment or when he requested them, if so what did he request?

Many Many Thanks.
