I am getting different answers from my consultant and from this forum for some of my queries, which are really worrying me. Could you please clarify these: :?:

1. Currently I am working on the work permit and have applied for HSMP. After I get HSMP and FLR(IED) approval, will the Home Office inform about approval of FLR(IED) and cancellation of current work permit to my current employer even if my employer does not contact them. I am worried that my employer may create problem if they come to know about it.

2. Consider a case that I leave my current job, EITHER during the period, when my application for FLR(IED) is under processing OR after FLR (IED) is approved. Then when my current employer informs Home Office to cancel my work permit, will they be informed by the home office that work permit is already cancelled and the person has switched over to HSMP?

3. If I leave the job immediately after HSMP approval. Will it affect my FLR(IED) approval, as work permit is valid for only 28 days more. Will my FLR(IED) get processed in priority in this situation?

4 During the period when the passport is submitted for FLR(IED), if I have to go overseas for the company visit will HO return the passport immediately?Will they return the passport with or without the approval? :?:

The HO will not inform your present employers. However, your employer is required by law to inform the HO if you leave the job.

No.

In theory it will not affect the FLR application but priority processing is only allowed if one of the urgent criteria is met – travel, a job offer deadline etc.

You can apply for urgent treatment and if all is in order, your passport will be returned with approval before your travel date.

Thanks for all these helpful answers, I find them very useful as I am in the same situation.
My passport is gone for FLR(IED) but no news yet from hsmp,so I am without a passport. And I can not do any urgent treatement of FLR as no HSMP answer yet!...
My current work permit (through employer) is still valid and my embassy has agreed to issue me a replacement passport. Please, do you think I can travel with this replacement paspsort (No leave to remain on it, only photocopy) without any problems?

Thanks hk_007 for your precise replies. In fact my consultant had given me exactly opposite reply and hence I was quite worried. They had told me that "Home Office will inform my employer about cancellation of work permit" I am really surprised that inspite of charging huge fees for their expertise they are unaware of these matters. Thanks again.

This is because we (forum and your representatives) have conflicting details about your situation - IMHO your post has too many holes..not sure what you are trying to do but playing the immigration system is risky business (no offense meant).

Do we have an umbrella situation here? Why would HO contact current employer unless they wanted to verify your employment details...remember you gave them your consent. If they are satisfied with the quality and integrity of the documentation submitted they don't contact your employer unless for quality control basis i.e. the answer is they may or they may not.

Once you your HSMP FLR(IED) application is submitted or approved why would the HO contact your employer? I see no reason why they would. As per a previous response your current employer should update the HO if/ when you leave their employment.

You should not leave your job before the HSMP FLR (IED) is submitted. I see no reasons for priority processing other than those published by the HO.

Why would you be going overseas? It seems there are issues with your employment? If you ask for your passport back for travel reasons prior to FLR IED approval and stamping then the entire application is classed as abondoned. Unless you intend to use such a visit as reason for 'urgent' treatment..see HO criteria for such.

I note your original post has been edited twice - I recall the initial post asking about acquiring a 2nd passport to facilitate your travel whilst the other one was with the HO for FLR IED processing - sorry this is illegal/ misrepresentation..how can you vary leave when you are not in the UK?

Thank you for the clarifications. Though you have answered all the queries you seem to have understood it through a bit of negative intentions from my side. All these issues are very sensitive for me because my employer has high level contacts and is very much fussy about such developments. Mine is a clean case with no illegal intentions. But with your feedback now I am relaxed. Now I need to take this up with my highly paid consultant for their casual feedback.
