Some advice please on ILR on my situation

Post by lovenutcracker » Mon Jan 08, 2018 8:27 pm

Hi guys.

Wondered if you can help me.

Here's the situation:

I've been legally in the UK for 9 years and 2 months and been on a Dependant Leave to Remain permit since 2012. My Dependant Leave to Remain permit is dependant on my mother's permit which is a Spouse permit which she received the same year (2012) as mother married a UK born english man after a long overdue divorce from biological father of which mother experienced domestic violence. My mother's permit is based on a 5 year route Spouse permit. My permit and also my sister who is also on the same permit as I am expires in April 2018. By April 2018 I would be here for 9 years and 4 months.

Now based on this situation, what form should we use to apply for Indefinite leave to remain?
SET(F)?
SET(LR)?
SET(O)?

We have called the immigration number which is 0300 123 2241 but was advised multiple things and said they cannot advise which form to use.

Please help.

I have my english test at Trinity College of London coming up as well as the Life in the UK test soon.

Kindest Regards and God Bless.

Mr. A

Set(O) and Set(F) are not applicable to you. You can only apply Set(LR) if you have 10 years long residence, which you don't yet.

If you are on a dependent settlement visa based on your British step parent, then you can apply on Set(M) based on5 years residence, same as your mother.

Thanks for the reply.

My permit is dependant on my mother who is not a settled person but married my step dad who is British.

We are all applying on the same day at Croydon but need to know which form..

If your mother and the children have a visa dependent on the British partner/step parent, you can ONLY apply on Set(M). You can only apply if your mother applies.

You don't state the exact words of what your visa says but the assumption is that that is what you are on due to the British partner/step parent.

Thanks for that. I was just confused with SET(M) as it states on the guidance that children over 18 must apply separately.

Thanks again x :)

Yes, on a separate FORM not at different times.

Right so on a separate form meaning a separate SET(M) form or what my mother is going to fill out and put on there as a dependant?
