Tier 2 General - Extension Application refused

Hi,
My Tier 2 extension application got refused on 09/11/2017 due to Salary requirement didn't match against my SOC Code . I was on SOC new entrant 2472 @ £21,750 previously and on my new COS it was left same. My employer will have to request for a new cos with home office and at this stage how should I be handling the situation. Looking forward for everyone's kind information.

Hi Sptula,
I work as a Public Relations officer and I work for a Home Decor distribution company. On my extension COS the salary was not increased it was down as same as last time.

You require the experience rate as far as I understand, quoted below. You will also have a huge shortfall in salary if your aim is to apply for ILR at some point.
2472 Public relations professionals Example job tasks
• discusses issues of business strategy, products, services and target client base with senior colleagues to identify public relations requirements;
• writes, edits and arranges for the effective distribution of press releases, newsletters and other public relations material;
• addresses individuals, clients and other target groups through meetings, presentations, the media and other events to enhance the public image of an organisation;
• develops and implements tools to monitor and evaluate the effectiveness of public relations exercises.

Related job titles:
• Account manager (public relations)
• Information officer (public relations)
• PR consultant
• Press officer
• Public relations officer

Salary rates:
New entrant: £18,800
Experienced worker: £23,600

Hi CR001,
Thank you for your swift reply. Since my Visa expired on 19th September 2017 and now my extn application got refused, my employer is ready to increase my Salary to match the requirement to £23,600, but will have to request for a new COS as the current one is already allocated for another staff. Could you guide me on what to do next please also am I eligible to work for the same employer at the moment ?

Hi ,
I made my Tier 2 General Extension application as detailed below;

Ist Issued Work Permit in Sep 2014 & Expired on 19th Sep 2017

17/09/17 - Submitted T2 Extn Application.
29/09/2017 - Received Biometrics Letter
13/11/2017 - Received HO application refused letter with decision date as 09/11/2017.
Reason for Refusal - Didn't meet Appropriate Salary.


Could someone help me with queries listed below, please?

1. My employer is ready to review my salary and is okay to issue me a new COS. HR will be requesting for a new COS on priority service, so am I eligible to apply on 27/11/2017 or will have to apply by 23/11/2017 as on the letter received the decision date is 09/11/2017 and I received the letter on 13th Nov 2017?

2. Am I eligible to continue working for the employer or will have to stop working till visa is sorted?

3. If I have to stop working until my visa is sorted what date I will have to address ?

4. What date is ideal to be in my new COS as Starting Date?

5. My wife ( Dependant) is on her maternity leave with maternity pay and will have to rejoin back by the beginning of December, what all things she will have to look into before starting to work with her employer?

Hi ,
My Tier 2 Extn application is refused on the background for not meeting appropriate salary. My Visa already expired on 19th Sep 2017. If my employer issues me a new COS. Am I still eligible to address as exempted from RLMT?

You can submit another application within the next 14 days from your refusal date

2. Am I eligible to continue working for the employer or will have to stop working till visa is sorted?
You can continue working as long as you are able to submit another application with 14 days of refusal

3. If I have to stop working until my visa is sorted what date I will have to address ?

4. What date is ideal to be in my new COS as Starting Date?
I guess you can use a start date that is 2 - 3 weeks ahead.

The most important thing is to get your sponsor to request a new CoS using premium service. Once you have the CoS, it can be assigned to you with increased salary information and then you submit your application.

Could I clarify on below query please as I am making my second application to extend my visa and have doubt on 2 questions?

1 . Do you currently have a Visa or Leave to Remain?

My Visa expired on 19/09/2017 - Submitted Extn Application 17/09/2017 and got refused on 09/11/2017.
Should my answer to be - NO

2 . Have you ever refused a visa for the UK?

Just to confirm - Should my answer be Yes, ( Visa Application refused.

My visa has been approved and I thank all of you who helped me to process the application. Please see below timeframe it took ,
Tier 2 Visa Expired on 19th Sep 2017
Application Submitted Date: 17.09.2017
Application Refusal Date: 09.11.2017 (Reason - Didn’t meet Appropriate Salary)
2nd Application Submitted: 18.11.2017
Approval Email received from Case Worker: 07.01.18
All Docs Received on 10/01/2018

Start Date : 14.11.17
Expiry Date: 14.08.2020

On my extension application, I received only 2.8 Years is it correct?

That would be because you cannot have Tier 2 for more than 6 years and as your original visa was issued on 14th August 2014, the expiry date of your new visa now is exactly 6 years.

If I want to apply for PR based on Long Residency, I will be 8 months short to complete my 10 years stay in the UK. Will I have any options left to make a successful application?

You will have to find a visa you qualify for. You won't be able to apply for tier 2.

Hi CR001,
I already did my masters here on Tier 4, am I eligible to apply for another course and switch to Tier 4 just before my Tier 2 expires or do I need to leave the country and apply from my native country and will it affect on my 10 year LR route?
