Set(m) settlement child born in the UK

Post by chibakun » Tue Jan 02, 2018 8:41 pm

My wife is going to apply for settlement in January 2018. We had a baby daughter in November 2017 in the UK, and my daughter has UK birth certificate.

I'm not sure how to answer some of the questions in the Set(m) form:

My wife is a "single applicant on form SET(M) and no dependants are applying with you". She has no dependants because the child was born in the UK, right?

Do we need to fill out 2C?
(SECTION 2C: YOUR RELATIONSHIP WITH YOUR CHILD - Complete if you
are applying as a parent of a child who is present and settled in the UK)
Image

Also, what about SECTION 3: CHILDREN UNDER 18?
What confuses me is that the child isn't applying for ILR.

Finally, SECTION 4: WHICH CATEGORY?
Not sure whether it's
Spouse of a person present and settled in the UK - 2 year route
or
Partner of a person present and settled in the UK - 5 year route

We have done FLR(m) twice , in Dec 2012 and then in Jan 2015. I don't get why it says Partner and not Spouse for the 5 year route.

Thanks in advance.

She has a dependant child. But as you are British, child is automatically British.

Section 2C is not applicable if she is applying as your partner and not as a parent.

Section 3 is not applicable if child is not applying for ILR.

"Partner of a person present and settled in the UK - 5 year route" seems appropriate.

Thanks Vinny

My wife is currently on the 2nd part of FLR(m), having first got FLR in Dec 2012.

Do we have to fill out section 8B Maintenance?

(iii) you are applying as the parent of a child settled in the UK

Hmm...?

SET(M) documents

Post by chibakun » Sun Jan 14, 2018 5:23 pm

On the settlement M form in the document section it states you need to send photocopies of all documents.
You should photocopy each of these documents and
provide the copies in addition to the originals.
Are they really asking for a copy of everything we send , because we are send ~50 pages (bank statements, correspondence, ...)?

Set M ILR Daughter born in the UK

Post by chibakun » Tue Jan 16, 2018 4:04 pm

My daughter was born in the UK. Her mother is Japanese and applying for ILR.

Do I have to mention my daughter in the free text box and include her birth certificate?
