Granted 2 Year Extension instead of ILR -Asked to pay NHS Surcharge as Spouse - part 8 2 year route pre July 2012

Post by DimitriosN » Mon Jan 15, 2018 8:39 am

Apologies if this has been asked but I couldn't find anything on it.

We applied for ILR for my wife and attended the Croydon Office. We were denied that based on English requirement - long story short they do not accept anything apart from what is on the Home Office list.

They have granted a 2 year extension and in the letter it says we should pay using the Spouse - part 8 2 year route - pre July 2012. The problem is I can't find anything like that on the drop down menus.

Any tips would be very helpful

Regards

The online form asks
Were you originally granted leave on the basis of an application made before 9 July 2012 as a partner on the family route?
The answer would be "yes", if she applied for a fiancé(e) visa or a spouse visa prior to 9th July 2012 and subsequently applied for FLR(M)?

Hi Vinny,

On the first page the website asks:

Are you applying from within the UK? (Yes) and
Are you applying to stay in the Isle of Man, Jersey or Guernsey? (No)

After that it asks for details (name etc) and has drop down menus for the Visa Route and Visa Type but in those menus I could not find any references to pre July 2012. It lists FLR, FLR (HRO), FLR (IR), FLR (O) and the Tier applications.

I can post screenshots if it ould be helpful.

Hi Vinny,

I did, but I thought this was for a new application. In the letter provide to us we are asked to go to: https://www.immigration-health-surcharg ... ment/start

We have already been granted the 2 year extension - provided we pay £400.00.

At the moment the only thing I can see is to pay £500.00 using the FLR for marriege and request a refund for the extra £100.00.

Regards

I'm sorry, I misunderstood.

Yes. It should be £200 per year. I agree. If you pay more, then you can ask for a partial refund afterwards.
