Tier-1 Extension: Self-Employed which option to apply with?

Hi guys,

I'm doing contracting having my own one-man company, have taken almost 70% of my profit of last year income via director salary and quarterly dividends. HSMP guidance says there are two options available to apply under, which are quoted below.
As per my case could you guys recommend which option should i choose? I reckon it's option 1 that suites me which requires minimal evidence i.e. only my personal bank statements, dividend vouchers and salary slips.
Salaried Employees with Dividend Payments:
If the applicant is paid through a combination of salary and
dividends, and both payments appear on the applicant’s
payslip, salaried employees with dividend payments could
provide:
• Their personal bank statements covering the full 12 month
earnings period;
and either
• Pay-slips covering the full 12 month earnings period; or
• A letter from their employer.
If the applicant is paid through a combination of salary and
dividends and both the salary and the dividend payments do
not appear on the applicants payslip, salaried employees with
dividend payments could provide the above documents plus:
• Dividend vouchers, for each dividend payment claimed,
showing both the gross and the net dividend.

Self-Employed Earnings within a Business/Company
Structure:

If an applicant has worked in a self-employed capacity
through their own business/company structure and has
chosen to retain their earnings within the business/company,
they could provide:
• Business/Company Accounts - prepared in accordance
with statutory requirements and showing the net profit
generated for the earnings period claimed; and
• A letter from their accountant confirming the details
contained within those accounts.
If the applicant is not the sole shareholder of the company
they should also provide :
• A letter from their accountant confirming their shareholding
and the proportion of net profit before tax to which they are
entitled for the earnings period claimed.

You are self employed.

Hi,

As per the Tier-1 guidance note:

Contractors:
If the applicant is a Contractor and is operating neither
through their own company nor as an employee, they may
provide the following:
• An accountant’s letter confirming a breakdown of their
gross and net earnings for the period claimed; and
• Personal bank statements clearly highlighting all credit
payments made to their account from employment
undertaken during the earnings period claimed.

I feel your case will fall under the above category.

Hi Please see the paragraph 87 below clearly mentions that if you have been drawing enough money as your salary though you are self-employed.

87. For applicants in salaried employment the applicant’s gross
salary before tax will be assessed. This includes self-employed
applicants drawing a salary from their business. If the
applicant’s earnings were generated in a country with no tax
system, their total earnings for the period will be considered.

My question is do we still need to go under transitional arrangements inspite of qualifying for 75 points. also i think transitional arrangements for self-employed is different from the transitional arrangement for maintenance funds i believe. please clarify as i can show proofs only for one month before application.

I am employed and doing 35 hours per week. I also own a company (sole-trader) and providing IT services. I can only qualify 75 points when calculate salary from both source.
In which category should I apply for extension?
1. employed
2. self-employed

Please advice.

Am in this same suituation and don't can only qualify for 75 points if i combine salaried and selfemployement
breakdown is as follow

salaried=£27,000 before tax
self employement=12600 before tax

Earnings can be from self-employment + permanent employment (Salaried)

If yours is a single person company and if the net profit is £12600 which you are entitled, then as per the below documentary evidence you should clear the required points ie (Salary from permanent employment + Net profit entitled).

From guidance note:
Self-employed applicants only - Letter from the applicant’s
managing agent/accountant (confirming that the applicant
received the exact amount they are claiming, or the net profit
to which they are entitled)
