Hello everyone

I have been following this thread for some time now, hanging on to every new info

I'm an EU national moved to UK in May 2017 and wife is non-EEA.
Below is the time line
6 June 2017 - Applied for EEA family permit (Within 3 months of my arrival)
21 Aug 2017 - Got application not straightforward email
After multiple escalations finally on 9 January 2018 they made a decision with my wife received today after collecting the passport - EEA family permit rejected.

Reason given
1. "EU family memeber passport or id not submitted" - This is false as we clearly submitted a copy
2. "No evidence of marriage or photos" - This is also false as we submitted marriage certificate along with tons of photos (may be 50+), whatsapp chats, emails etc
3. "No evidence that i'm exercising EU treaty rights" - This also false as i had been in UK under 3 months since arrival when the application was submitted there is no need to exercise treaty rights

My wife and i are shattered after waiting for 7 months for the Visa they have refused.

Not sure what to do next :(

Hey Kap, where did you apply from? and did they let you appeal your case or not? My husband also applied in 23rd June and still awaiting decision, he applied from Nepal to be with me here but they are taking forever to grant visa.
Done couple of escalations but doesn't seem its working lost all the hope and so stressed out with this waiting.
Still hoping to get good news trying to be positive.
May be your wife has to reapply because there is not any better option that I know. Take care

Application does not attract right of appeal as you have failed to supply any evidence that you are related as claimed to the EEA sponsor - Did they even check the evidence as we had submitted tons of it!!

Unfortunately, there are many new officers, who are not very experienced. Many time I have heard of their mistakes, you could even receive somebody’s passport by mistake...
Anyway, you have two options. Or to reapply again, indicating in your cover letter what mistakes they have made with your first application. Now seems the processing time is not as long as was before, many people have already received their permits in a month time.
And the second option is pass the UK border ( between UK and France) by ground without visa, just to have all documents which are required for visa, derective, explaining that your wife has rights to enter without FP and the most important you to be with her when she’s crossing the border. Many people (recently) have done it, it took them less than 10 min to get a stamp.

Dont let yourself down, there are solutions!

Hello ,
Don't let this throw you off balance. Reapply again. I mean ASAP.
I know of cases that took over 2 years but they never gave up. They were only reunited last week Saturday.
I've waited over 6 months myself
Infact let this strengthen the bond between you and your wife.
Reapply ASAP

I applied from Abuja but no news yet.
I called a week b4 Christmas, but didn't get any email acknowledging my call. By the way that was the 3rd time I will be escalating.
Fast forward to today, I called to reescalate and the operator advised that I should stop calling!
All she said was I can assure u ur documents are under consideration.
Bro, this one weak me.
It's 27 weeks now but let's keep believing.

Kap 295,
There is nothing special about crossing France- UK border ( same like any other border). In order to have an entry stamp, you should, first of all, be together with your spouse while crossing, have all documents which you have prepared before for the visa( sponsors UK details, marriage certificate, ....) and in case printed detective 2004/38/EC

1. You said you submitted a copy, the guidelines say that you have to submit the original or a CERTIFIED copy
"your family member’s valid passport or national identity card (or a certified copy if you can’t provide the original)" - from gov.uk website.

2. Was the certificate of marriage in English? If not, does it come with a translation in English? Did you attach pictures of the wedding? Maybe of the reception as well, to show them that you had a proper wedding and not an arranged one?

3. Since you moved to the UK in May and your wife applied just after, may I ask you why you didn't wait for the outcome of the EEA FP first, applying for her as ACCOMPANYING you and not joining you in the UK? As I did, I waited first for the outcome of the EEA FP for my wife before both of us moving to the UK attaching a cover letter explaining that I wanted to find a job in the UK and I wanted my wife with me. It gives them the feeling that you don't want to leave your wife behind.

If it works out this simple, i literally wasted 3 months waiting for nothing. It only takes 6 hours driving from where i live to the port of eurotunnel... But without EEA FP, can we work legally in UK? Or should apply the resident permit first? But now without my passport, i can't do nothing.

Without even EEA FP it is very very rare that someone will offer a job to a non EEA national. You should wait for the residence card.

I think from my personal point of view, that all this rejection of visa applications is nothing but a new policy followed by the UK in a nonhuman manner. Its purpose is to not ease migration. The European immigrants were placed in awkward positions either to stay half-family or leave the UK, there was no other reasons to refuse after waiting for a long period of seven months, most applications over the past two weeks were rejected for the same reasons

Its to hard i have newborn who I never seen there and thy keeps playing them gams with eea to get better benefit! That’s very bad people got tired of that

My point of view is that I applied for my wife's FP (february 2017) and my wife's daughter's FP (december 2017) , then I helped 3 friends with their applications (may 2017, september 2017 and october 2017) and all of us received the Permits in less than 2 weeks. I still think that people waiting for 6 months are not following the guidelines 100%.

2. Was the certificate of marriage in English? If not, does it come with a translation in English? Did you attach pictures of the wedding? Maybe of the reception as well, to show them that you had a proper wedding and not an arranged one?

3. Since you moved to the UK in May and your wife applied just after, may I ask you why you didn't wait for the outcome of the EEA FP first, applying for her as ACCOMPANYING you and not joining you in the UK? As I did, I waited first for the outcome of the EEA FP for my wife before both of us moving to the UK attaching a cover letter explaining that I wanted to find a job in the UK and I wanted my wife with me. It gives them the feeling that you don't want to leave your wife behind.

I think from my personal point of view, that all this rejection of visa applications is nothing but a new policy followed by the UK in a nonhuman manner. Its purpose is to not ease migration. The European immigrants were placed in awkward positions either to stay half-family or leave the UK, there was no other reasons to refuse after waiting for a long period of seven months, most applications over the past two weeks were rejected for the same reasons
I have waited more than 7 month And still waiting no even any sign
150 working days
Its to hard i have newborn who I never seen there and thy keeps playing them gams with eea to get better benefit! That’s very bad people got tired of that

But never giv up whats ever it will take
My point of view is that I applied for my wife's FP (february 2017) and my wife's daughter's FP (december 2017) , then I helped 3 friends with their applications (may 2017, september 2017 and october 2017) and all of us received the Permits in less than 2 weeks. I still think that people waiting for 6 months are not following the guidelines 100%.

I have written to you above post. Recently around 10 days ago, couple of people had successfully passed, all procedure at the border - about 10 min. They had gotten the stamp in their passport and now are preparing documents for Residence Card. Yes, you take euro tunnel ( all information about trip you can find on their web site)

Finally! I got my visa today. It was mailed yesterday in my previous house that I used to live in. I applied since July 10, 2017 and today is January 14. During those span of months that I have been waiting tormently. Finally! I got it! So please don't lose loose hope and keep praying!
I will be with my husband in my birthday and our anniversary
My congrats finally you get it and hope all of us will get it soon

Yes,I submitted original and photocopies just to be sure,then my husband wrote a letter stating his financial support that he can support me during my stay in U.K and provided the room accomodation from his landlord and prove to them that our relationship is genuine. I also attached our communication logs from text messager,Facebook messenger with the dates on it, viber,emails,video calls screen shots,photos of our marriage and photos of us during his 2 months stay in the Philippines. I would like to add that aside from passport if you have a authentic birth certificate and has a remarks of "delayed registry" or shall I say after your mother gave birth to you and she only process your birth certificate after days then it may fall to a "delayed registry" and that's what happened to me. So I provided them with my school records from elemetary and high school records just to let them know that my name really existing since the day I started schooling. Aside from that,my husband is working full - time as a mechanical engineer to a company and we provided them his pay slips,income tax return for the last 1 year, a contract from his company,a landlord's letter that he's been living to a house with a spacious room rented for years and added to that,a permission from his landlord that he is informed already that his tenant will be having a visitor which is his wife from Philippines. I hired an agent who process visas and I am also sharing this information to all of you so you'll have an idea. Just prepare everything you can provide for your document,anyway it is on the hands of the UK embassy will do the judgement. At least we did our best. Stay positive that your EEA visa will be granted. I am praying for those who applied and keep on waiting that soon your EEA visa will arrive at your doorstep. I know how hard it is but keep on being positive no matter what.

I would like to ask if I can travel to Romania with my EEA husband,he is Portuguese but living in U.K and has a permanent residency there. I am currently got my visa of EEA recently and he wanted me to come with his trip in Feb.09,2017 for one week vacation together with our Romanian friend. They already got their plane ticket except me cos I just received my EEA Family permit last Jan.14th.
Do I need to apply for a Romanian visa to get in Romania? Your response will be much appreciated. Thank you.

They took my passport too, but I provided a photocopy whether it is necessary or not. I just provided it though. Just keep on praying. I believe it really works even if you're on a depressing mode just think that it will come in God's time.😁
