Hello,

I am currently in UK on Tier2 General visa and my wife is on Tier 2 Dependant visa. Our applications for ILR are still under process and we are likely to get our ILR in April (i.e. 6 months after we applied in last October).

In order to be eligible for naturalization, one should not be away from UK for more than 90 days in 1 year after getting ILR. We are expecting a baby (in August) and I would prefer my wife to deliver the baby in my home country, and that means she might have stayed more than 90 days outside UK by April 2019 (i.e. 1 year after getting ILR).

Can anyone please tell me if it could get her naturalization delayed if we decided to get the baby delivered abroad?

The 90 days absence limit relates to the year working back from the BC application date. You can delay the application at your convenience.

If the child is born in the UK after you or your wife gets ILR, the child is a British citizen automatically and you can apply for its passport.

If the child is born abroad, the child will need to be registered as a British citizen under Section 3(1). That will require the child to have ILR, along with at least one parent having naturalised.

You may want to factor the cost and ease of registration into the equation.

There is no compulsion or time frame for naturalisation. Your wife can get naturalised whenever she meets the requirements. That means a wait of at least one year after getting ILR, but your wife can get naturalised at any time after the one year period, so long as the absence and other requirements are met.
