::Urgent::Query regarding Absesnce on Article 10 RC and deregistration

Post by Bobthemoggie » Tue Jan 23, 2018 11:26 am

Hi Guys,

I have question about permitted absences for Family member of EU Cit Article 10 RC.
I understand that- in a given year its upto 6 months.
In Netherlands (EU Cit & non-EU FM) are registered with Municipality at current address.
And here Municiple registration, tenancy agreeements & Residence permit seems to be internally connected.
If they go away for few months; In that case kindly advise on below scenarios-
1) is it possible to deregister for Family members with Municipality?
2) In worst case, if EU Cit needs to move to another property in Host country, while non-EU FM are away?
3) Or if EU cit moves to another property & if he can not register himself with municipality?
4) In case, EU cit moves to another EU country for work while non-EU FM are away.

Tried calling local immigration authority but they couldn’t answer this query.

Please advise
Cheers,

If you don't give up your residence why should your family members deregister at the Municipality?
If you give up your residence all residents from the family have to deregister.
Continuity of residence is not broken for a absence up to 6 month for both eu citizen and family member.
So where is the problem?

Thanks for your reply.
Yes. there's no imminent need for de-registration.

A) I am forseeing a scenario- where due to work, EU Cit might have to shift to another city in the Host Country. But as family members aren't present so getting their names on tenancy agreement & thus onto new address could be a challenge.
[Somehow registration, immigration status, tenancy agreement & monthly insurance payments are all interwoven.Even Immigration authority apeared to be confused - on one call they said, you better deregister & go for longer break & on another call they said- avoid deregistring.]

B) If after non-EU FM goes on longer break (upto 6-months) & if EU Cit moves to another EU country as worker (just for example- ROI), in that case, will the RC be of any use to non-EU FM's to fly to Ireland directly from outside EU?
Or above referred scenario of EU Cit deregistring himself, will inevitaably make physical RC card invalid for travel on airline from outside of the EU / for transiting through Schengen Zone? (if this happens within 6-months)

Kindly provide your expert opinion.
Cheers

a)
If you have power of attorney you can act in her names.
b)
As long as the RC is valid it can be used. Why should the dutch invalidate the RC? They would have to wait at least 6 month anyway.
