Working abroad and impact on spouse visa

Dear all

I am looking to work as an expat (Baku) from may this year onwards while my wife stays in UK. Her visa will be up for renewal next year in May.

I will be employed by a UK company on 6 weeks on and 2 weeks off rotation plus I will get my holidays etc. I will be paid in UK bank account and will pay UK tax. all flights etc be paid by company.

We own a house here and mortgage is on joint names along with council tax bills and utility bills.

I would like to know whether it will have any impact on the application? I work in oil and gas and due to downturn in industry, I might have to take that step.

It will have an impact as you aren't living with your wife for the majority of the time.

What cane be done to reduce the impact? If not ILR, would the application for further leave to remain be a safe step when it comes to applying?

For a spouse visa extension, you also need to prove 'subsisting relationship' and cohabitation plus all the same financial requirements.

The HO will notice you didn't pay tax from that period on. Perhaps you'll have to submit evidence that you both kept in touch while you were abroad. There's no guarantee the application will be successful though. I was here on a student visa while my husband was working abroad for a UK company and my application was refused. He also worked in the UK for the same company 180 days per year, but the HO wants the spouses to be here full time --unless they have to work abroad temporarily on an intra-company transfer scheme but their employment must be in the UK.

Because of your absence they might use the excuse that the relationship is not genuine and subsisting.

Thank you very much for replies.

Seems like it can cause problems. Worst come I will take up the job in the meantime and get some permanent employment here in UK from Feb 2019. Visa application will be in May 2019. I can explain the reason of overseas employment due to downturn in the industry. I will keep the emails/letters of all the unsuccessful job applications made in UK which kind of pushing me to go abroad on rotations for the sake of my career.
