Turkish Husband, English Wife - Immigration

Hi
I wonder if anybody could give me some advice please. This is really just general advice at the moment.
I am an UK national, my fiance and I are due to get married in Turkey later on this year. We have a forthcoming baby, due on August 2008 who will be born in the UK.

When we are married, he would like to come to the UK to work. He has been a ladies Hairdresser for over 20 years.

Now..... we will obviously be married at the time we apply for the visa but I want to find out what could make his application stronger? I am worried he has very little money in Turkey, so on his visa application it would not show that he was afluent. However, he would be moving here to work and definitely NOT claim any public benefits.

We are hoping that he might be granted just a visitors visa for a holiday here at christmas time, but later we will need to apply for the working visa.

Has anybody been in a similar situation, or indeed if you are Turkish and have come to the UK I would be so interested to hear from you about your experiences.

Depending on when you are getting married and how soon your partner would like to come to the U.K, you could apply for a spouse visa from Turkey. The spouse visa allows the holder to live and work in the U.K for a period of two years. At the end of the 2 year period, you can either apply for Indefinite Leave to Remain (ILR) or Further Leave to Remain (FLR). The former extends the visa indefinitely and the latter extends the original visa for one year (or two – can’t remember exactly).

Thanks Sammie, thats a great help. I hope eventually when we apply we dont have too many problems. We are intending to get married this October and then start the process after that.

My advice would be for your husband-to-be to apply for a settlement visa as your spouse after your marriage, as Sammie advises. That way your husband will be able to work in the UK too.

I don't think his current financial situation matters too much in the case of a settlement visa application. The ECO will be more interested in if you both as a couple are able to maintain and accomodate yourselves and your dependents without recourse to public funds in the UK. So his finances in Turkey would be irrelevant really..

Can you apply for the settlement visa before the wedding? I'm getting married in August and they've told me that applications are taking up to two months at the moment, and I don't want my bride stuck in Turkey for two months after we are married.

You would need to provide the marriage certificate for the settlement visa. You could always get married in the local registry (or equivalent in Turkey) and get the official certificate, submit the application and then have a bigger wedding whilst you wait.

Hi

I'm British, married to a Turkish man. We had neverending problems getting him in to England on a spouse visa, but he does have a complicated immigration history. We submitted all our applications through the embassy in Istanbul but my advice would be to submit your application in N Cyprus - the feedback we have had from firneds who have been applying for a variety of visas is that things generally get done quicker there and with a much higher success rate. Wish we'd known that then!
