Hello everyone,
I am writing this query on behalf of a family friend ehose Limited Leave to Remain as a spouse expired 2 years ago and she didnt bother looking at her documents afrer coming here thunking she has been granted a visa for 10 years 🤦🏼‍♀️. She has two sons who are British aswell. Now when she checked the documents shes quite scared and depressed as she has unintentionally over stayed. She called a lawyer who said its not a big deal and asked her to fill FLr mp form and submit the application with all the required documents. Or maybe after telling the situation to the HO they might give her a penalty fine and grant her extension. Nobody is giving her correct answers or solutions and shes really confused. Is there anyone whi can guide her pls?

Just to confirm this in any way to connected to me. I just got visa spiuse visa exrended 1 week agi and thats whn she told me the whole story

She won't qualify for FLR(M) as an overstayer.

She should apply for FLR(FP) Partner route.

Does overstaying matter? If yes then what are the possible outcomes of this situation?

Overstaying always matters. It will exclude her from applying for Citizenship for 10 years from the date she now gets a new visa, if she gets one.

FLR(FP) will also put her on a new 5 year residence period (if she meets the English and financial requirement) or a 10 year route (if she doesn't meet the requirements). There is no guarantee that she will be granted a visa.

She has no access to free NHS and should be paying for her NHS usage at 150% of cost.

Currently these applications are taking many months, sometimes longer than a year to decide. Often refused.

She will have to pay the visa fees and the Immigration health surcharge of £500.

Thanks for ur reply. She has read all the rules and will pay the visa fees aongwith health surcharge. I have also told her about English Language requirement because I aso recently gave A2 Level test before applying for my spouse visa extension.
Will tell her everything tomorrow. Is she asks anythung i’ll ask here.
