PBS dependent or Visitor Visa

Dear all

I am applying for tier 2 visa and shall start my work from March. My Family (wife and 2 Kids) want to come to UK in June and then we shall assess whether we want to continue or go back to India. They will be in UK for one month only and then travel back and decide whether wnat to come to UK or not. whether we should apply for visitor or tier 2 dependent visa.
1. If Tier 2 dependent visa can they visit for one month and go back
2. Is it compulsory for them to come back to UK before the visa expires.
3. Can they apply for Tier 2 dependent visa for a period in excess of 6 years restriction.
4. What are the rules for absence for dependents

Kindly advise. Any help is highly appreciated

1. Yes.
2. No, but wife's qualifying period for ILR may reset. She may require subsisting marriage evidence.
3. Their leave's expiry date cannot be later than yours.

Thanks alot Vinny for your reply. Could you please clarify if they go for a dependent visa come back in one month and apply for a dependent visa say after 2 years, will the be able to qualify for ILR if they tay for 5 years after that, and would they get a Visa for 5 years.

Vinny could you please clarify 'marriage evidence'. We are married for 15 years now, have kids 11 yrs and 7 yrs, have joint bank accounts, our passports have each others name as spouse and we have travelled to many countries together in the past. Moreover we hold most of the properties jointly. What period of separation calls for this proof of marriage. we are never separated since we got married in 2003.

Your wife's and children's' period of leave under 319D(a) and 319I(a) respectively, would depend on yours. Your wife may qualify for ILR, if she has continuous dependant leave for at least 5 years and you qualify for ILR.

If your wife remains out of the UK and you are in the UK, then you are apart. If you are apart when she applies, then she may need subsisting marriage evidence.
