Urgent Help regarding Set (LR) After appeal right exhausted

Hello Everyone,

I am asking this question on my friend's behalf

His appeal right has been exhausted on 1st Dec 2016 , and within 14/ days he applied FLR (HRO) application and then varied to FLR (LR) on April 2017 , Then varied to FLR (FP) but No Decision has been made till to date and he completed 10 years today 08-02-2018.

Questions:

1: Can he apply for same day Set(LR) ? or any other options he has ?

Especially after changes made to long residency rules on 24 November 2016.

2: What his chances are ?

Tricky situation to be honest.39E section says 14 days of overstay can be disregarded but section 3c ends when appeal rights are concluded ,basically without 3C you are not eligible for iLR .i had same situation and my visa was refused with right of appeal .
It depends on caseworker to be honest .some people who are lucky enough got positive decisions too.

Did you apply set LR before you complete 10years and will HO give you an in country appeal rights
