ILR for dependant child.

Post by Lily1972 » Sun Feb 11, 2018 10:03 pm

I am Brazilian and my husband English.
I hold an ILR but not British citizenship.
My 17 year old son was living in Brazil with his father who sadly passed away two years ago, my son stayed in Brazil living with his grandmother but due to unforeseen circumstances it’s not longer an option and he came to join me in Uk a few days ago.
He entered the country on a visitor visa.
Can I apply for his ILR from UK?
I was told he needs to go back to Brazil and apply from there, but I can’t accompany him because of my work and I have nobody to assist him there either.

Regards,

Lily.

I think that child may switch to SET(F). Include proof of deceased father.

However, explain the change in circumstances since his arrival in the UK, as one condition for a visitor is that he leave the UK after his visit.

He's cutting it very close, if he's near 18.
