Tier 1 dependent ILR amendment

Post by SamGh » Mon Feb 12, 2018 7:22 pm

Hi
I have ILR through Tier 1 G route since sep 2014. I am applying for my wife's ILR as pbs dependent now. My questions are
I declared my income lower to HMRC after my ILR but later amended it (after the twelve month period) and have paid the correct amount of tax too.
I claim wtc ctc and cb in my name.

Will these effect her ILR application.

Thank You.

Tax credits MUST be claimed in JOINT names, Child Benefit in your name only. :!:

What I meant was that the claim is in my name and the payments come into my single account.

Thanks

Yes, but what I mean is did you claim tax credits in your name only? You are required to claim wtc & ctc in JOINT names, even though your spouse has no recourse to public funds.

Have any of your tax credits been calculated on your under-declared income, prior to your income amendments?

Has you wife worked during the period you have claimed tax credit?

Note:

Thanks for your prompt reply.
Yes the Tax credit claim was in joint name however her immigration status was properly declared at that time.
The underdeclared income was for tax year 2013-14 which were later amended at the start of 2017 and the tax paid with accrued interest in march 2017.
The wt claim was made at the end of 2014 and declared income for the year 2014-15 Was the same as what was put on the claim form as expected income.
Yes she did work for 3 months but then got pregnant. Her income was duly reported at the start and the end of her job to the claim authorities. The amount for the claim was duly adjusted for the period concerned.

Thank you.

Why do you think YOUR tax amendments will affect your spouse's application??

I just got worried after tax amendments were affecting adversely tier 1 G extention or ilr applications.
I hope its a false alarm for me.
