Hi Maxmilan
I'm sorry to hear your application is still being dragged on.
I had the approval letter on Wednesday this week.
I hope you will get a positive answer soon
good luck to you
Hi Jegs82
Congratulation for the approval letter and happy to hear that.Can I ask did you do any legal action which caused the result or no please?
Max
Hi Max,
I did not take the legal action, I only did a pre-action protocol in January and they just gave a standard excuse response for that. I was confused as to take a proper legal action.
Approval letter eventually came through last week!
Only think I did recently is I changed my driving license to my current address, not sure if that has helped!
Good luck to you mate, I got a feeling that they must be going through all old pending applications.
Thanks
Hi Jegs82
Thanks for your reply.Just can I ask that what is pre-action protocol and how can I do that please?
Hi Max,
Pre-action protocol, is a document/form you send to someone before you actually taking a legal action.
Its basically indicating your intention to take legal action, so you list your concerns and put for a resolution you are expecting from , Pre-action protocol is a powerpowerful tool, but UKBA are using the good character requirements as an excuse to not to commit to your suggestions to resolve the case
So I did the below
Section - The details of the matter being challenged;
Application for British Citizenship was made on 07/11/2016, Home office is yet to make a decision on my appilciation for over 12 months.
1- Home office has failed to make a decision within published service standards of 6 months
2 - Home office has failed to make a decision within a reasonable time frame.
and for section The details of the action that you want the Home Office to take;
Failure to make a decision within a reasonable time frame due to omission/misplacement of my application has heavily impacted my day to day normal life, I'm under severe stress and not being being to travel oversess to meet my relatives or for vacation, as I have to be in UK for over 12 months to respond to any correspondence Home Office may have.
Therefore I request home office to locate my application and process it within next 8 weeks, if that is not possible I request home office to set out the extact and resonable time frame they will be able to make a decision
As mentioned before, UKBA did not commit to my suggestions, but Im not sure if this helped me to get the case worker to look into my case bit more actively
Thanks
