Proxy Marriage - BR/IT

[MARRIAGE BY PROXY]

Hey guys. I am going to marry with my boyfriend by proxy in the next months. We are both brazilians but he also holds Italian citizenship. He's currently living in Italy (and he will move to the Scotland after we get married). I'm living in Brazil. Do you think that we might have problems when applying for EEA Family Permit because we're not going to be together when we get married? A friend of his will represent him here in Brazil at the time of the civil partnership. I appreciate any help.

Someone told me that the civil partnership certificate would not be sufficient and that I'd need to show numerous additional documents e.g. A letter from the eu embassy. Is that true? I don't have money to get a expert solicitor/lawyer and there isn't additional information in the Gov.uk website :(

I didn't mention that we are both guys, we know each other since August 2015 and have been living together between Feb 2017 and Jan 2018. Now in February he's in Italy. I think we don't have problem proofing that our relationship is genuine.

You will need to check with your country if marriage by proxy is legal? If the answer is yes,then you may proceed.Also you will need a letter to state from your country that the marriage cert is valid and legal anywhere is presented.

Secondly, your half will have to come to UK to get work and use the paperwork with the relationship paperwork and apply.

Hello Wise. Thanks for the advice. Yes, proxy marriages here in Brazil are legal. Do you know where should I require this letter in Brazil (consulate, embassy, register office)?

Secondly, the paperwork you mean the playslips that show that he’s working?

Brazilian proxy marriages are recognised in the UK, certainly for EEA migrants.

Your Italian spouse will need to start exercising treaty rights (such as by working) within three months of arriving in the UK. If he is working, then payslips would be an acceptable form of demonstrating exercising treaty rights.

There's one more question. Do you think that it would be better to apply for the FP with both brazilian and italian marriage certificates or we don't need to do it? As long as we marry in Brazil we should be able to transcript the marriage in Italy. I don't know if this action would be necessary to "proof" something more. What do you think?

You don't need to marry twice but once you have done it Brazil,get letter from the registrar to proof the validity and possibly from your embassy in UK. Otherwise HO might decide to push you around a bit.

If you want you may as well just register and interpret your marriage with Italia embassy anywhere but that will only make the country to recognize your marriage and be useful in future if you want their nationality.
