Post by Lakshmiz » Fri Feb 23, 2018 1:07 pm

Hi Everyone,
I need advice regarding my child ILR Visa..

Currently I am on ILR visa and my wife got her ILR last month, I couldn't apply for ILR to my child along with my wife as she was away from uk close to a year for maternity purpose and I didn't want to risk of rejection for both, by gods grace she got her ILR, now I want to apply for child can you please tell me what documents should I provide for my child ILR and should I use SET(o) form ?

My child is in UK for past 3 and half years does she need to complete 5 years in Uk to apply for ILR Please confirm...

Thanks

I believe child has a choice of SET(O) or SET(F).
She may apply now.

Alternatively, If she was born in the UK, then she is entitled to register.

There is no maintenance funds requirement for PBS dependents applying for ILR.

Hi CR001,

actually I thought of applying for British citizenship directly for her along with me but as it was looking risky it got delayed and now applying for ILR with in person (premium service) ... and I couldn't find the date for her visa appointment before that date..

Dear LK,

I have given the detail on the below post.
uk-tier-1-general-visas/ilr-for-tier1-d ... l#p1620583

MY wife and son is initially on tier 1 general dependant (PBS dependant) , I did extension with the FLR(M).
My son is born in India and he is only 3 year 10 month in this country.

Please can you suggest if you are also in the above situation and got ILR for both your wife and son.
Also suggesy if your son born outside UK and you applied for ILR before he completing 5 years in UK.?
Did you apply ILR for your wife and son together?

Sorry for lot of questions . Please help me.

Thank you CR0001 for the clarification.

I switched her visa, becuase I did not had option to extend the visa on same type as I already got ILR.

Even in the immigration the officer asked me why you are in ILR and your wife is on tier 1 general dependant visa. (i.e. coming from holiday before her visa extension)
