Tier 2 (General) Dependant Form and Finance

Tier 2 (General) Dependant Form and Finance

Hi guys, I have recently acquired ILR from Tier 2 General route while my wife is still on Tier 2 Dependent. She will be eligible for ILR in April 2018.

I have following queries:

1. Will the new 180 day absence rule apply to her? She made first entry to UK in May 2013 and most recent on 25th Jan 2018.
2. Are the absences post 11th Jan 2018 counted for 180 days rule or previous too?
3. Which form to use ? Set (O)?
4. She is not currently working so what maintenance proof should I be showing?
5. What should I answer in question 5.4 as to what regular income she receives from me? I generally transfer £200 in her account but not regularly. Is that a problem?
6. For cohabitation, how many documents are sufficient? Her maiden surname is still continued. Could this be seen as a negative?

Any advice would be great.

4. No maintenance required
5. That Answer should be "No". The question is basically if someone gives you, her or both of you money. Not if you give her money.
6. 3 types of documents spanning over the last 2 years. 6 documents in joint names or 12 individual documents in your name and hers. Maintaining maiden name should not be a problem. You can just include marriage certificate to be on a safe side but it's not required.

Sorry one more query. For English language requirements:

1. Would she need to meet english language requirements as Tier 2 dependent applying for ILR?
2. Requirement says "an original letter or certificate from UK NARIC confirming the equivalent level of your degree, plus an official letter from your university with your name and degree confirming that your degree was taught in English" . Can NARIC certificate and degree suffice or a recent letter from Uni is required too?
3. Is there any other easier way to prove English language requirement? She does hold Masters degree from India.

1. Yes
2. If the applicant has a degree that was taught or researched in a non-majority English
speaking country they must provide:
• their degree certificate
• an Academic Qualification Level Statement (AQUAL) from UK NARIC confirming the
qualification is equivalent to a UK qualification
• an English language Proficiency Statement (ELPS) from UK NARIC, which will confirm
that the degree was taught in English.

3. Answer to 2 above will still be the easiest in my opinion
