deported but back in uk.

i was deported from uk in 2007 having served 3 months out of 6 months sentenced for identity fraud. i came into uk 2005 with my wife and my 2 years old son. i have another son in 2006 before i was deported in Dec 2006. i came back again in 2007 February and i have been here since them. my wife and the children have been given their right to remain here with the son i born in uk given his british passport. i was refused based on my 2006 issue. now we are heading to court on this matter. what chance do i have regarding my staying with my family in UK? no further criminal record since 2007. i have a british son and another who has spent 13 years in UK as well as my supporting wife. do i stand the chance to win my appeal for FLR visa in court?

So, just to clarify, you were deported due to identity fraud and you have come back to the UK by committing it again. And after having it done twice, you want a visa to reside in the UK? Can you see a certain irony here and why the judge may not be entirely sympathetic to your case?

Judge may either take sympathetic approach and look at it that you were desperate to see family and be with them. Especially because you have 2 children. That would be a good result for you.

Did you appeal the refusal at all or did you just use fake identity straight away?

What was the identity fraud you were jailed for?

Judge may look at is as you completely destroyed your credibility by committing identity fraud twice.

i have never committed any further crime again since i reunited with my family over 10 years. The said crime was over 10 years ago. Likewise, the appeal hearing have been set for OCTOBER this year and there was a mandatory order by the appeal court from the letter i got, for the RESPONDENT(HOMEOFFICE) to send to ME their ground of decision making which lapsed in APRIL 15. Yet to receive nor hear from them. Based on your experienced and observation over time, is the HO taking this seriously or they have something sinister over the sleeve?
