British Citizenship guidance for Child under 18 years MN(1) Sec 1(3)

Post by vicky_2 » Fri Mar 16, 2018 10:28 am

Hi All,
Can anyone pls advise me on my situation. I tried to contact 2 solicitors, and look like they are all busy.
1> Me and My Wife got ILR, Mar 2018.
2> Our Baby born on Jan 2016, at UK and never travelled outside UK, has UK Birth certificate and Indian passport issued from the consulate, and no UK visa and no ILR
3> I heard under Section 1(3) of Form MN1 we can apply for British Citizenship for my baby

Question
1> I found online the Jan 2018 version of form MN(1), but cannot found the Section 1(3), where I can find the form MN(1) for Section 1(3)?
2> the First page of Form MN(1) I found a question "1.3 State if and when the child was given indefinite leave to enter/remain in the UK." But we have taken the ILR for baby. Is this section 1(3)? Then I need the ILR for my baby, before British Citizenship?
3> I understand MN(1) form if apply via NCS at the local council, they return the original document on the same day. Is NCS application is faster or applies by post is faster? If I have to travel urgently I can get back by BRP if applying via NCS?
4> For MN(1) application, is this can be done personally or it is advisable to hire a solicitor.
5> After receiving British Citizenship and UK passport for my baby, do she have to take Indian visa or OCI before travelling to india, whereas we have Indian passport?

Thanks in advance.

1. It's Section 1(3) of the British Nationality Act 1981.

2. UK-born baby doesn't need ILR.

3. Yes. NCS is probably more convenient, as you keep original documents.

4. Could do it yourself.

5. Probably OCI?

Either will do. OCI is nice since it's for life, but it can take up to 6 months to process. Regular travel visa is much cheaper and you usually get it within a week or so. NOTE: You should surrender the child's Indian passport after registration goes through and don't attempt to use it out of 'convenience'. They are rather picky about that right now.

It seems that only the form got updated in January 2018, due to an out-of-date question. Therefore the 2017 guidance should still be valid.

Replaced application form as it contained an out of date question.
13 January 2017
Updated form and guidance.

MN1 Online filling - Referee DOB, Passport no

Post by vicky_2 » Wed Mar 21, 2018 9:20 pm

Hi All,
I have been advised by NDRS (Natonal document return service) to fill the MN1 online.
When I start filling it, in referee page, i got completely devastated.
It is not only asking Referee name, DOB, Passport no as a mandatory field.
I am currently in chat with GP to sign the Referee form, but what on earth, they will give their DOB and Passport no.
Now, if i can say Referee is not a British Citizen I can skip the passport no field, but DOB cannot be skipped.
giving junk values not possible. writing NA not possible.
anyone faced the same issue?
