Financial requirement A or B

Hello everyone.
We are in the middle of my spouse visa application and we are a bit confused regarding how to meet the finacial requirement.

Here is our situation!
My sponser has a 36 hours contract per week but this varies depending on how many hours he is given meaning he is on a non-salaried contract/employment , so basically he gets paid every 4th friday and his income is always varying has he works more hours than what he has been contract, he gets paid 13 times annually instead of 12. He has been with the same employer since october 2015.
My question, do we apply under category B since category A show that we are short of the income threshold as my sponsor took leave to vist us in sep to oct 2017. We are over £20000 for the past 12 months of payslips. Can you please clarify which category we likely to be succesful?

CAT B has two parts - 1) needs to be currently earning£18,600 pa AND 2) in the past 12 months has earned £18600.

What was your lowest pay slip in the past 6 months?

Thank you for your quick response.
Lowest payslip is £900
But for the past 12 months we have earned over £18600

Your current job- what is the annual salary, if no annual salary stated on contract; What is the total of last 6 months payslips?

Hello , current job's annual salary is £20000, but this is a non-salaried employment, has my sponser gets paid per hour

Just to clarify: From April 2017 to March 2018, my husband's gross annual salary has been over £20,000. He has been with the same employer for over two years, but April 2017 is when they offered him more hours and we were able to start meeting the requirement. His job is not salaried, it is paid hourly, and his pay varies. He gets paid every 4 weeks, giving us 53 salaries per year. 6 months ago he took unpaid leave from work to be here with his family for several weeks. Despite this, he still grossed over £20,000. But if we submit evidence under Cat A, the money he dropped when visiting us will drag the average down in the calculation, and we are worried they will say he hasn't met the requirement, even though he earned more. So we want to submit under Cat B and provide 12 months pay slips and bank statements, but are concerned they won't permit this as he has been with his employer for over 6 months, albeit on hourly rate, not an annual salary. Can we safely apply using Cat B in these circumstances?

Reason I asked is to see whether you can actually do CAT A soon. CAT B requires more calculation and paper work. Either way very hard to calculate which category you meet with the info you provided, so i'll leave it to other members to provide an input. CAT B is not as easy as just earning £18,600 past 12 months, there is more to it as mentioned earlier.

9182.40/6×12= 18364.8

With above figures he can't apply under category A and equally not sure that whether will you can meet category B - 2nd part where you must have earned during the last 6 months the wages which average total accumulation gives at least £18600 per year (in case of non-salaried person).

Do you/both have some savings around:

18600-18364.8×2.5= 588+16000= £16588

Hello, at the moment we dont have saving amounting to that.
Since my sponser get paid weekly which totals to 52 weeks anually( 13 times a year) . Can we be able to calculate 9182/6 ×13? OR
Since he is scheduled to work 45 hours with an hourly rate of 8.1 can we calculate 8.1 ×45 ×52?

I am afraid but you have to only follow up the official calculation. However, one thing you can try again to recheck the total of last 6 months wages by firstly calculate it weekly because as per your initial post suggest that sponsor gets paid 4 weekly. Try to firstly convert into weekly wages then multiply by 26. Maybe by this way required wages figures come.

My sponser and i think it would be a risk to apply under cat A or B as his income for last 6 months amounts to £9182.40 as he had to take unpaid leave to visit us hence the short fall. If say we wait for next pay slip we can apply under A for last 6 months and the fall will be covered, under the non salaried employment.
Now since the spouse fee is likely to go up we were hoping we could apply before the increase and submit the 6 months of payslip with 5 months of bank statement since the april statement will only be issued later,as it will not have been issued at the time of application.
Would it be ok to explain why one statement is missing to the ECO and that it has not been issued but we provide 6 months payslip? P60 will also be issued later.
Please as we are in desperation.

Why not print latest statement online and get it stamped at your branch. That is one option.

No, this would not be ok. The mandatory requirement is to submit 6 months paysliops and 6 months corresponding bank statements. You risk a refusal if you do not submit all the mandatory documents.

According to immigration dirctorate instructions family migration
Appendix fm section 1.7
Appendix armes forces
Financial requirement August 2017 and i quote!
Page 33 financial calculations.
5.5.21. Any period of unpaid maternity, paternity, adoption, parental or sick leave in the 12
months prior to the date of application will not be counted towards any period relating to
employment, or any period relating to income from employment, for which Appendix FM-
SE provides. For example, if a person takes 2 weeks’ unpaid parental leave, this period
will be discounted and will not be considered to have broken any continuous period
relating to their employment or to their income from employment, and the person can
show that they meet the annualised average income required over a period of 6 months
and 2 weeks prior to the date of application.

"financial requirement to be met by a person applying for entry clearance to,
leave to remain in or indefinite leave to remain in the UK as the non-EEA national
partner or dependent child of a person (British or foreign or Commonwealth) who is a
