Dear Sir\Madam


I am British citizen with new born British citizen, just one month old

My Wife is Algerian with six months tourist visa here in UK, and maried abroad in Algeria since August 2016

I need to extend my wife visa, her visa will expire soon

What form i need to fill in .

I am interested in premuim service. how to go about it.

Extend her visa for which visa category?

If the baby was born in the UK, did she pay for all her pre-natal and post natal and the birth if she used the NHS??

You cannot switch visa categories within the UK if you are here as a visitor on a visitor visa.

Why did she not apply for a spouse visa before coming to the UK and doing it the right way??

We did not know, othewise we have done it while we where abroad.

You really have not made this easy for your spouse.

Her only possible option is FLR(FP) Partner route. It can take many months to get an answer and possible refusal as this is often the route people use to avoid the more strict spouse visa from outside the UK.

It is straight forwards , or i need solicitair for this

If yes, Which one you recommend

No it is not straightforward. She is in the UK on a visa that does not permit switching to other visa categories.

Makes no difference, she is now going to attempt to circumvent the spouse visa entry clearance immigration rules by applying within the UK as a visitor for leave to remain on the FLR(FP) route, when she should have applied for the correct visa (spouse visa) before coming to the UK.

What is your annual salary, do you meet the financial requirements?

The simplest will be to apply for the proper spouse visa from home country.

FLR(FP) Partner 5 year route she needs English test as well I believe. There is no guarantee that she will be successful though applying to try switch within the UK, when she could have applied from home country as you clearly meet the financial requirement.

You also need to bear in mind that as a FLR(FP) Partner route application can take 12 months or more for a decision to be made, your wife will be unable to travel outside of the UK during this time as the Home Office will retain her passport.

Also as has already been advised, this would be a 10 year route to settlement (ILR). FLR(FP) is a long and bumpy path to take, with no guarantee of success. The Home Office are taking a tough stance on someone entering on a visitor visa and then attempting to circumvent the Immigration Rules to remain in the UK.
