Salary Cheque Bounced - What should I do now? Spouse visa

Post by barokut » Thu Apr 05, 2018 10:14 pm

Hi,

Long story short. Checked my online banking yesterday only to find out that from one of my jobs, my salary cheque has bounced due to security reason.

I intended to apply for a spouse visa under Category A on August 2018 (which will be 6 months from Feb 2018) but now I'm not sure.

I am aware that ECO take the lowest amount in a 6 months period and use that to calculate the income requirement. "For example: £1680 a month multiplied by 6 then divide by 6 then multiply by 12 = £20,160."

I went to the bank last month to deposit my cheque in and it shows on my statement that on 28th March, I did indeed go there to deposit but on 04th April (yesterday), the statement shows that it has bounced.

Due to my cheque being bounced for the March 2018 period, I believe it basically means no actual money came into my account even though it shows "CHQ £875.99 - 28/03/2018" on my statement.

What should I do? Can I continue to go ahead and apply in August 2018 and explain in the letter of what happened during March 2018 and hope for the best or should I wait until October 2018 and apply during that time which will be 6 months from this month?

If it helps, here are the details of my two jobs. One of them I get paid by cheque (Star Grill). And the other is Faster Payment (Job 2).

Here are the salary breakdown and future scheduled payments (all net income):

XYZ (Cheque)- Gross payment is £902.72 per month. Net is £875.99 per month:

Feb 2018: £875.99
Mar 2018: £875.99 (Bounced due to security reasons)
Apr 2018: £1751.98 (Amount that were bounced in previous month will be added for this month confirmed by employer)
May 2018: £875.99
Jun 2018: £875.99
Jul 2018: £875.99
Aug 2018: £875.99

ABC (Faster Payment) - Gross payment is £780.00 per month. Net is £612.00 per month:

Feb 2018: £612.00
Mar 2018: £612.00

(Minimum Wage Increased - New Salary Figures) Apr 2018: £638.04 net (Gross is now £830.00)
May 2018: £638.04
Jun 2018: £638.04
Jul 2018: £638.04
Aug 2018: £638.04

I don't think that you can apply under category A because your main job is not producing the sufficient income to meet the visa requirement. Under category A the official guideline and its examples doesn't allow to combine the incomes from two different employers which category B allows. For category B you need to fulfill two parts. Firstly you must have earned at least £18600 during the last 12 months with the combination of all jobs and secondly during your last 6 months you must have earned at least £9300 with the combination of all jobs.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Hi. Thank you for the reply. I have read the Appendix_FM_1_7_Financial_Requirement_Final which states that both jobs can be combined under category A and used to meet financial requirement. I've also come across some forums that people were able to get their spouse visa using 2 jobs under category A. Hence why I believe that one is able to apply under Cat A for if he/she has 2 or more jobs.

I'm asking that since the cheque has not cleared last month, it would mean I'd have to wait another 6 months perhaps?
