Travelling to Europe after Overstaying a visa in Portugal and UK Denied Entry

Hello everyone!

So my Brazilian boyfriend is facing a couple of issues that we're trying to figure out the best way forward as we're planning a trip to Lisbon via Rome.

Firstly, he was recently denied UK entry last month so he has a black stamp on his passport with black pen cross through it (in case these details matter?!) Just because he didn't have a return flight booked and had no money -I was happy to be his sponsor but the border said there were a few other issues i.e. he'd been travelling for the last 6 months and didn't have strong enough ties with his home country of Brazil.

Second issue is that he overstayed his visa in Portugal last year by 30 days so he left by bus to Spain to try sneak around it.

So he thinks the solution is to cancel his passport as he's heard that with the UK black stamp, it's best to start a new passport so he doesn't have trouble travelling in Europe. Also , he thinks that when he visits the Portuguese CEF Visa Service to get his new visa, with a new passport they may not discover his 30 day overstay last year.
Does anyone know whether this is true? I thought surely they must keep these records on their own database and not rely upon paper passports to gather their information or maybe I'm too used to the stricter UK systems?


There is a strike happening in the place in Brazil where he needs to get a certain voting document in order to start the passport application and the strike is only thought to finish on 23 April (our flights are booked for 21 April) So we'd have to change our flights and accommodation to at least the 15th of May to give enough processing time.
But he's learnt today that this strike could go on for even longer so we're getting increasingly frustrated at this situation and wondering if he should just travel on his old passport and making sure he has all the right funds and documents in place when he travels but he wants to try and cover up his black stamp (with an Indian visa sticker he has from another page which fills up the whole page) I've seen how it looks and it does work perfectly being stuck on another page but I still worry about whether the Italian border will see his name on their database from either the UK black stamp or his overstay in Portugal anyway? And then they'll see he's hidden his black stamp with the sticker and he can get in trouble for trying to conceal something?

All they need is your date of birth and name and all your travel history for YEARS up to 10 years I believe will show up in their system along with any remarks. To think that a new passport will not show this is being a little ignorant and naive imho.

A passport is a property of a sovereign government, it is not the holders property, any tampering or trying to "conceal" is just outright illegal and he may face a heavy fine or even criminal charges in some nations for example. DO NOT try this at all, in case concealing does not mean the EU border guards cannot see it their systems.

Now, about getting a black stamp from UK for the reasons that you gave, has no real consequences when it comes to schengen entry, residence or exit processes, these are solely EU(schengen) border control matters and the discretion is solely on the EU border guard. Overstaying in portugal means overstaying the entire schengen area, going to spain will NOT let is slip by, its all essentially one border for the entire schengen area. If he had overstayed, during previous exit from schengen even if they dont/didnt say anything, Coming back at a later stage will flag in their system that the subject did overstay the previous time. And be prepared for some questioning leading to a fine mostly or even denied entry in some cases.

If the reason for overstaying last time for genuinely unintentional that you should not worry too much if you can answer the questions.

'Doctoring' his passport will almost certainly be detected by Border Control Officers who are well trained to spot f a k e documents. This will result in a lengthy travel ban. Don't even consider it :!: :shock:
