Hi Friends
I got my initial entrepreneur visa on 8/05/2013 till 08/05/2016. I applied for extension on 06/05/2016 but on 09/06/2016 my application was rejected as invalid. 17/06/2016 I applied for fresh application but it refused on 25/08/2016. I did admin review on 06/09/2016 but it was also unsuccessful on 03/10/2016. I applied for fresh application again on 12/10/2016 and finally I got visa on 04/12/2016 till 04/12/2018.My questions are...
1) my continues live of 5 years or 10 years are broken?
2)Was I over stay as the application was out of time?
2) Am I eligible to apply for 5 years or ten years rout?
My job creations are as below during these two years
Employee 1: 05/12/16 to 05/12/17 ( 12 months as a part time, 69 hours month)
Employee 2: 05/12/17 still May 2018 ( as a full time 130 hours par month)
Employee 3: 05/12/16 to 06/04/17 ( 4 months part time 69 hours month)
Employee 4: 06/04/17 to 05/06/17 ( 2 months part time 69 hours month)
Employee 5: 06/06/17 still continue (as a part time 69 hours month)
Regarding job creation my questions are
1) How should I combine these jobs and make two full time jobs?
2) Can I combine employees 1 and 2 and make one full time job? Both jobs are existed 6 months each year 2017-18)as a single job ?
Or
3)if employee 2 work full time for 8 months and at the same time employee 5 work part time with him for 8 months for the same job (05/12/17 to 05/08/18) Can I combine them together for the same job/post and make 12 months one full time post/job? Then can I apply for ILR in August 2018? But don’t understand Home office says
“One full time job of more than 30 hours work a week will not count as more than one full time job”
Or
4) Job 1: Employee 4- 2months part time
Employee 5- 6months part time
Employee 2- 8 months full time
Job 2: Employee 1- 12 months part time
Employee 3- 4 months part time
Employee 5- 8 months part time
These are the calculation till July and thinking
to apply in August. If is there any other way I can
combine job please suggest. What about 104 weeks of job creation? Am I fullfil it or not? It’s really confusing but need your help please..

Honestly, you need to instruct a lawyer for your job creation query...... you know you need a lot of document to support your job created is accountable....

basically no one can help you about job here.

1) my continues live of 5 years or 10 years are broken? yes broken, because your extension was invalid and your visa expired. 3C leaves not applied. And how can you count 10 years?


2)Was I over stay as the application was out of time? yes.


2) Am I eligible to apply for 5 years or ten years rout? the gap less than 28 days can be disregarded. But i think your job creation and also tax returns may be much more conplicated than your gap.... instruct a lawyer to sort this out.

so what's your immigration status between 2009-2013?
either 5 or 10 years route, they only count the time you spent in the UK with valid leaves.

any gap between student visa and tier 1?

by the way, between your invalid tier 1 extension application to your third application for tier 1 extend, there are 4 months. As your second application made after your visa expired, 3c leaves not apply, and your second application also failed so the gap is 4 months. not sure this gap can be disregarded, but likely not. Because 3c cannot be regained by making fresh application after last visa expired. the HO avoids ppl keep making invalid application to extend their stay in the UK. likely your clock reset to start again on 2016, thus you are eligible only on 2021. Ask for second opinion is better.

I am going to apply entrepreneur Ilr extension next month.I have
Employee 1: 05/12/16 to 05/12/17 ( 12 months as a part time, 69 hours month)

Hi Sun26,

I think, you can combine employee 1 and 5 to make one full time position and the rest for the 2nd full time position.Assuming your full time employee works for 9 months and the remaining 3 months are done by 2 part-time employees, you can fulfill the 2 full time job requirement.This is just my thinking, as i am not sure whether we can combine the employees having same job title and working at the same time less than 12 months can be considered or not.Wait for some other members to get response.
