ILR Application - Shortage Occupation List

Hi,

I am currently on Tier 2 general visa and my Visa expires in August 2019. However, I am eligible to apply for ILR in June 2018 as I would complete 5 years in Tier 2 General visa in June. I am currently on shortage occupation list job code (2136) as I am a 2D/3D games developer. My current salary is only £33k which is below the required minimum salary of £35k for ILR. My question is, Can I still go ahead in June and apply for ILR as it states in gov.uk website that I don't need to meet the minimum earnings threshold if my jobs is on shortage occupation list. Has anyone got their ILR on shortage occupation list not meeting the minimum threshold?

Yes, for occupations in shortage list need the specified salary to meet, not this minimum threshold of £35500. And if you are completing 5 years in June you will be eligible to apply 28 days before your completion of 5th year.

Just checked in SOC2136 you will need to prove £32000 only, so you are above that. Relax! :D

Gap between Jobs - ILR

Hi,

I am currently on Tier 2 general Visa and eligible to apply for ILR in June. This is my second job in Tier 2 visa and I have a gap between this job and my previous one as my Visa application for the second job got rejected the first time. The gap is however less than 60 days. I am wondering if this would affect my ILR application. I read that 60 days rule has been removed since Jan 2018, So, does that mean you can have gaps between two jobs while on Tier 2 visa?

ILR - Shortage Occupation List - Absence Letter

Hi,

I am planning to apply for ILR under shortage occupation route. My job code is currently in the Shortage occupation list. I was on tier 2 general for one year with a different employer and 4 years with my current employer. Is it mandatory to get absence letter from my previous employer? They might not have record of my absences in their system now as it has been 4 years since I left them.
Could someone advise me on this please? Also, is there a template for employer and absence letters please?

I also would like to know if my employer needs to specify anything about my job code and it being on the shortage occupation list please? Are there any additional documents that I need to submit to let Home office know that my current job code is on the shortage occupation list?

You also need a letter about your job/SOC etc and required 'for the foreseeable future and will be paid x for the foreseeable future'.

I was also on Maternity leave for 11 months during the 5 year period. Should this be mentioned in the Absence letter?

My maternity leave started on the 13th of june 2016 and I was back to work on the 15th of May 2017. I was in the UK for most of my maternity leave and I was out of the country from 4th dec 2016 until 11 Feb 2017.

I was also on full pay for first 6 weeks of maternity leave, half pay for next 8 weeks and statutory pay for 25 weeks and no pay for the last two months of mat leave. Would this affect my ILR application?
