Tier 4 Student visa part time work start

Post by sptula » Fri Mar 02, 2018 5:45 pm

Hi Team,

I am currently in UK on Tier 2 ICT Dependent visa, also doing part-time work in a local store

I secured admission into a postgraduate course at one of the universities in London.
My course is starting in mid of may
I am applying for Tier 4 General (Student) visa from India in March month.
Am planning to travel UK back around 3rd week of April as I can travel 1 month from course start date.

My question can I do part-time work before the course start date?
Or it should only be after my actual course start date?

You know you can study the course with the leave you already have?

See Immigration Rule 245ZW(c)(iii) and the Tier 4 Policy Guidance paragraphs 300-324 which explain the Tier 4 work conditions.

Paragraph 305 of the Policy Guidance clarifies that the period after your studies is considered a vacation, but there is no provision to work during the maximum one month period before your studies.

My main applicant is on ICT visa, so its always uncertain how long his employer will keep him in the UK on deputation. I don't want to discontinue my study if his employer asks him to relocate.

That's why applying for Tier 4 General Student visa

Did you read the information that it is referring to, in the Employer's Guide to Right to Work Checks? It is on page 18 and it also says that the employer needs evidence from your university that you are following the course. A university could not provide such confirmation if you have not yet started the course. I can't see any employer being satisfied with evidence of your intention rather than having actually started the course.

Personally, I think that reference to working in the period before the course starts is an error, because it is not reflected anywhere else in any Rules or guidance, and especially because of the above contradiction.

Funda Maintenance proof

Post by sptula » Tue Mar 06, 2018 11:10 am

Hi,

I am going to make application for Tier 4 Student visa.
I have made Fixed deposits in an Indian bank for visa fund maintenance. Opened the FDs on 31st jan 2018 valid for 6 months.

Are we allowed to show Fixed Deposits as proof of funds for maintenance?

Usually banks do not provide statement for FDs, they only issue Deposit confirmation slip

As a netbanking user,I can download the Deposit confirmation statement
Online stateme nt states: "This is a system generated Advice, and hence does not require any Signature"

please suggest what should I be doing in this case

Shall I get that online confirmation signed and stamped by the Branch ?

Yes. See page 96 of the Tier 4 Modernised Guidance for entry clearance officers and case workers:

The immigration rules do not mention certificates of deposit, but they require that self-printed bank statements need to be either stamped or signed, so it would probably be wise to also do so for a self-printed certificate of deposit. See Appendix C, paragraphs 1B(iv)(2) and 1B(iv)(3):

Hi,

I am planing to use the Bank account or Fixed deposit on my Spouse (Husband) name as maintenance proof

During CAS issue stage, university has come back saying I can not be sponsored by Spouse

Is this true that I can not use funds on my spouse name as a proof ?

Given your ongoing questions about various aspects of your Tier 4 application, I strongly advise that you seek and heed the advice of your Tier 4 sponsor about the application.

Hi, The CAS department of the university said

"
The Fixed Deposit is only in the Husband’s name – a Tier 4 applicant cannot be sponsored by a spouse. The applicant’s name needs to be on the account.
"

This is what worrying me and not sure if they are correct

You need to stop doubting the expertise of your Tier 4 sponsor. You can do your own research if you wish using the Tier 4 Policy Guidance, specifically paragraph 196:

You can use money held in an account owned by you or by your parents or legal guardian. If you are a Tier 4 (General) student and using funds held by your parent(s)/legal guardian(s), you will need to show us evidence that you are related to your parent(s)/legal guardian(s) and that you have their permission to use this money.

Student Visa maintainence funds

Post by sptula » Fri Apr 06, 2018 1:41 pm

I will be applying for Tier 4 visa from India in 2 weeks time.

I have enough funds £11385 available in a UK account to which I am joint holder.

Can I use UK bank statements for proof of funds although applying visa from India ?

UKCISA recently blogged about the myth that this is not possible:

https://www.ukcisa.org.uk/blog/6268/Tie ... rstandings

Again, given your ongoing questions about different aspects of the application, I recommend advice from your international student adviser.

Tier 4 Dependent Visa Category

Post by sptula » Thu Apr 12, 2018 7:39 pm

Hi,
I am trying to book Tier 4 visa appointment for in next week at Bangalore VFS in India.
I am preparing separate application for my Dependent child under category Tier 4 (General) Dependent Child

While visa appointment booking, there are 2 categories:
PBS Tier 4 Students
T4 Priority Visa

I know for myself (student), have to select 1st option PBS Tier 4 Students

Can you clarify what does "T4 Priority Visa" mean and whom does that apply to ?

You have paid the Immigration Health Surcharge as part of your application. If you do not know what this is, or what it covers, see https://www.gov.uk/healthcare-immigration-application
