Hello,

I am on a EEA Family Member Residence Card in the UK as a spouse of a German citizen also residing in UK. We married in August 2014 and I have applied for a divorce now.

Considering we have been married for more 3.5 years now, am I eligible to apply to stay in the UK post my divorce on the same residence permit?

Also I am a working professional, financially self sufficient and was never financially dependent on my spouse.

Your advise is highly appreciated.

You will need to apply for Retained Rights of Residence once you have your Decree Absolute.

Imperative that your spouse is exercising treaty rights at the time of Decree Absolute and that you have the evidence of the EU sponsors activity etc and ID.
