Spousal Visa to ILR 60 month

Post by ajturner » Thu Apr 19, 2018 9:56 pm

Good evening,

I am a British Citizen from birth and my wife has lived in the UK since September 2009. Firstly under a student visa, then PSW visa, then tier 2 general and since October 2013 under the FLR(M) spousal visa, after we were married in May 2013.

We extended the FLR(M) in February 2015 a couple of months before the 30 month deadline to ensure we did it all in time, thinking we were being diligent etc. The FLR(M) extension expires mid-August 2018, which is more than 28 days before the 60 month eligibility period for ILR is upon us (mid-October 2018).

I was hoping someone may be able to advise as to whether the time my wife spent on the tier 2 general (2 years) counts towards the 60 months for the ILR eligibility. If the answer is no, do we instead need to apply for a third FLR to bridge the additional couple of months until we are within 28 days of the 60 month period under FLR? If so it is going to get expensive :(

Many thanks for any guidance you can provide.

Time spent on another visa category will only be counted for 10 years long residence. Due to your early application for the last FLR(M) application, your wife will have submit an additional FLR(M) extension application. In addition to the visa fee, there will also be a payment due for the NHS surcharge.
