WP holder move to British spouse dependents

WP holder move to British spouse dependents

hi

We came to uk 3 yrs back on 5yr work permit from India. My wife and 2 kids also came with me on WP Dependent visa.

In 2001 my wife came back to india were we got married. She was living in UK with leave to remain (without permission of going back to home country as she was a failed asylum seeker but was given permissin to live in UK).

we lived in india for about 4 yrs after our marriage. In 2005 i got a job offer in uk and we all came to UK on WP visa. Since we came here my wife got Indefinate leave to remain from her previous asylum case. After which my daughter was borned (our 3rd child).

My wife recently got british passport in Feb 08.

Now my questions are
1. Should i register our marriage in UK by applying for COA - so that we can get my wife name on her indian passport and british passport same . Right now her british passport has her maiden sur name while her home country passport has my surname as her surname

2. Shuold we apply for British passport of my daugher - as she was borned after my wife got ILR

3. Is there a way we can get my self and my two son's moved on to my wife's case as dependent.

4. If all of the above is too complicated then should i wait for 5 yrs to complete on my WP

I work fultime but my wife doesnt work . she has her hands full with 3 kids. We dont take any benefits or child benefits or child tax credit.

I pay tax regularly and my employer is happy to extend my work permit

any suggestion on how we can move forward will be highly appreciated.

1. If your Indian marriage is already valid in the UK, then you cannot register it in England and Wales.

2. Yes, she may apply for a British Passport. However, she may lose her Indian citizenship, but be eligible for Overseas Citizenship Of India.

3. Yes. You may apply for FLR(M) and subsequently apply for SET(M).

4. Alternatively, you may choose to extend and remain on your work permit and subsequently apply for SET(O).
