SET (M) Visa Application

Post by mtahiriqbal13 » Sun Aug 20, 2017 6:39 pm

My wife came in UK in Sep 2012 as my dependent, she has been living in UK on dependent visa and switched to settlement after I got ILR in March 2015. Now I am British citizen since December 2016, can I apply for ILR for my wife under 5 years settlement rules? She is completing five years in UK next month.

No, because when your wife switched to a FLR(M) visa her immigration clock was set to zero, putting her on a new 5 years route to settlement.

She will have to apply for another FLR(M) extension of 2.5 years before qualifying for ILR. In addition to the visa fee, she will also have to pay the £500 NHS surcharge.

ILR or Visa Extension

Post by mtahiriqbal13 » Sun Apr 29, 2018 8:00 pm

Dear Forum Friends,
These questions may have posted several times but I couldn't find any thread related to my questions, so apologize for repeating the same questions again.
My wife applied for PBS dependent visa from Pakistan on 12th June 2012, got a visa on 4th July 2012 and joined me in the UK in September 2012.
Currently, she is on FLR(M) visa since 2015 and has completed 5 years in the UK in September 2017 (3 years as PBS dependent and 2 years as Spouse), so my question is, can she apply for ILR as she has been living in the UK for 5 years? or 2 years settlement route rule still applied to her as she got entry clearance visa before 9th July 2012?
If not in which category she has to apply for an extension?
Also, in all cases, she has to do English language course, so which course she has to do? She did A1 English course back in 2015.
Thank you so much!

No need for multiple posts/topics all in different parts of the forum.

Casa has already answered your questions, FLR(M) extension and she needs A2 English.
