duration of stay for 1 year

Post by jpkilo » Mon Apr 21, 2008 4:12 pm

hello, I'm a newbie in this forum. Very good information coming from this site.

I have a question. my mother has 2 year multiple entry visitor visa and is here in the UK at the moment. she will be going back home in June 2008 to finish her 6 months stay here. we are planning to get her back after 2 months (probably July 2008) here in the UK. I need her here to look after my 2 kids. i cant afford the nursery fees.

I wanted to know if she can come back here without any problems and stay for another 5-6 months.

I am presently studying in university and my wife is british citizen. I have read something about it here but i can't find the thread.

can somebody help me?

No she can't.

A visit visa is not a work visa, even unpaid work is counted as that so forget that. Also if the IO notices she's attempting to re-enter having already spent six months here she'll be sent back and probably have her visa curtailed.

If she's got a multiple entry vistor's visa she should be able to travel in and out of the country during the validity of the visa - providing that she doesn't stay more than 6 months at any time.

Having said that, although the rules allow for a relative to come and provide certain types of care, its usually to help the setled relative through a period of illness or something similar. Childcare for the purposes of studying and working is specifically excluded.

Such short gaps between her visits might indeed arouse the suspicion of an Immigration Officer.

Assuming that your children are British, is your wife not eligible for help through nursery childcare vouchers or Working Tax Credit? And who looks after the children when your mother's not around?
Oh, the drama...!
