Varying application

Hi I applied my Tier 1 entrepreneur extension application in February 2017 and varied it to FLR HR before the decision was made in February 2018. Now I am planning to vary the application again to Tier 1 entrepreneur extension application before the decision is made on my FLR HR application. I am eligible for my 10 year route in the month of August. So I am trying to buy some time. Can I vary my FLR to tier 1 entrepreneur extension now?

Yes but you are also at risk of being refused under 320(11) of the Immigration Rules due to vexatious or frivolous applications submitted simply to buy time

Why did you vary to flr when your application was pending? You could easily complete your 10 years on that.
If could make sense if your application was refused and you varied to flr but in your case I'm 100% agree with zimba. There is a risk that you will be refused.
I think you need to stay on flr until you complete 10 year.
Keep in mind one thing that home office can ask you for business activity and they can also call you for interview when you will apply ILR.

I am still running my business activity and running my employees. I am not sure if There won’t be any decision on FLR till August and so I am thinking of this varying again to tier 1 entrepreneur extension.

I think you are using a solicitor so it's best that your listen to him and not confuse yourself.
