Hi . Can eneyone help I got a marriage visa for my wife in 2009 but due to personal reasons and my lack of visa understanding she went home after a fee months came back again for 3 months then send back to see her family for a while but when she wanted to come back her visa had expired and I discovered this new English exam so she has been studying for a long time now so I want to know if we can simply apply for the FLR or do we have to start the whole application again once she passes the exam i would be greatfull on your thoughts

She has to start the whole process again from scratch. Any time she has spent here in the past as a spouse is lost.

She will now be on the new 5 year route to ILR (2 x 2.5 year visas) and will have to pay IHS fees as well and you must meet the financial requirement too.

She also needs to do the English A1 test at a Home Office approved test provider and the list changes a couple of times per year so make sure she does it correctly the first time.
