Child born Outside the UK to a ILR holder

Post by woking » Thu May 10, 2018 5:24 pm

Got same question

hope you can guide me in right direction.

i got ILR(10 years long residency ) recently, i have three kids. my eldest daughter was born out side uk and she and my wife joined me in jully 2010 as dependent of tier 4. Other two kids are born in uk.

Before applying to ILR they(wife and kids) were on dependent visa of Tier1 valid till august 2019 .

Please can you tell me Following:

1- can i apply Nationalisation for my eldest daughter born outside uk MN1 form ?
2- can i apply Nationalisation for my children born in uk using MN1 form ?
3- should i apply FLR(M) using Flr(m) form for my wife or she can apply IRL as well ?
4- Should i submit all application together ?
5- can i wait till their current leave expires in 2019 ? costing me too much if applying together

Regards,

1- can i apply Nationalisation for my eldest daughter born outside uk MN1 form ?
No. A child born abroad is expected to hold ILR and will only qualify for citizenship when either parent also applies and the other holds ILR.
2- can i apply Nationalisation for my children born in uk using MN1 form ?

Yes.
3- should i apply FLR(M) using Flr(m) form for my wife or she can apply IRL as well ?
She and your daughter born abroad will have to switch to FLR(M). They don't qualify for ILR as PBS dependents.
4- Should i submit all application together ?
FLR(M) and MN1 are different rules and departments.
5- can i wait till their current leave expires in 2019 ? costing me too much if applying together
You can, but they should not travel out of the UK on their current visas.

Why two FLR(M) applications? Mother may include child in her FLR(M) application.
