ILR application for Tier2 dependant

Hello!

Please help me to resolve one question.

My wife is Tier 2 General. I am and our son are dependants of her. We spent 5 years in UK and are applying for ILR. We would like to apply all together. The issue is that our son's first entrance to UK is 3 months later.
His situation in details:
Tier 2 dependant visa issued on 6 May 2013
The actual day of entry to UK 2 September 2013

Is it correct to count continuous 5 years presence in UK for him from May if the total days of absence from UK does not exceed 180 per year?
And thus, could our son apply with us?

We did read all HO documents, but this point is still confusing for us and we afraid to fail our application if we apply together.

Hello,

My wife is applying for ILR as Tier 2 General and I am applying as her dependant.

During online application we faced strange new requirement to provide document for:

"Evidence of immigration status in the UK".

And this is not the same as our current biometric residence permits as they already included in the another place in the form. We ask colleagues, who applied before, but nobody ever heard about such requirements and have no idea what HO is asking for. But we need to tick this, so we agree to provide this document.

Could you give me advise, what does HO mean by this?

It is the BRP card stating your visa.

Thank you very much for your prompt reply.
It sounds reasonable.
But my concern is why they ask about this evidence separately from BPS? It seems like they are talking about different documents.

You do realise that we cannot all see the online questions so don't actually know what you are referring to.

If you are referring to the checklist of what evidence you need to submit, then this is separate to any BRP question earlier in the form.

BRP and any approval letters of previous visas would do.

I was confused on the same matter.

On the check list it states 2 items as follows:
  • Evidence of Mr X's immigration status in the UK
  • Current Biometric Residence Permit
From my perspective the evidence for both is the latest BRP. Prior to this I can ofcourse show the Visa stamps on my passport but I do not have the 1st Tier 2 BRP as I have sent for my 2nd Tier 2 application.

Dont have the approval letters. Luckily Tier 4/PSW are stamped on my passport. The first Tier 2 biometric, I have a scanned copy of it. so should be sufficient.

Do we need to mention this in the cover letter that I'm submitting current BRP to prove this?
