ILR time calculation

ILR time calculation

Hi,
I have two questions about the time calculation for ILR eligibility and I'm hoping someone here could help clarify these for me please.

1) I came into the UK in July 2010 on Tier 2 ICT visa and then switched to Tier 2 General in July 2013, which started my 5-year clock for ILR. Tier 2 General Visa was effective from the 2nd July 2013 and I started my employment with the sponsor / current employer from the 15th July 2013, but between those dates I was very much in the UK. Could you please let me know if I should be using the Visa start date (02/07/2013) or the employment start date (15/07/2013) for calculating the 5 year eligibility?

2) Secondly, I have spent total of 245 days (including weekends) outside of the UK in the last 5 years since 02nd July 2013 as part of my annual leaves/holidays/weekend get-aways etc, but never at a stretch of 180 days in consecutive 12 months. Do I need to produce a letter of absence (from my employer) stating the dates of absences and highlighting that these were all part of my annual leaves.

You can apply 28days before completion of 5years your visa effective date OR if you know your Tier 2 application date then you can consider that as well to count your 5 years and of-course reduce it by 28days

Yes, you do need letter from your employer stating it was all paid leave

Thanks for the quick response. So just to clarify the point 1, I can apply any time after 4th June 2018. Is that correct?

Regarding the letter for absences, my employer has provided a letter of employment in which they have mentioned that I am entitled for 27 days of annual leave. They don't really know the exact dates of my travel, esp the small weekend get-aways. Is the above sufficient in your opinion, I can accompany it with a letter that specifies my travel dates, locations and reasons.

Give your travel dates to your employer and request them to give you a letter stating those dates confirming it was all paid annual leave/paid business visits. If you are still unclear, you can find a format on google if you search appropriately.

Thanks for your response.
Can I also check what list of NARIC certificates I may require to prove my knowledge in English language please? I have done Bachelor's of Engineering from India and have a Statement of compatibility from NARIC but it doesn't state that the qualification was in English. Although I have a bonafide certificate from my college in India confirming that the course was taught in English. Are these two documents (NARIC's statement of compatibility and College's certificate for course's English medium) sufficient or do I need another certificate from NARIC stating that the course was in English?

You need the NARIC comparable assessment and language assessment. It costs £150, UKVI red route NARIC.

Thanks, but I already have the statement of comparibility from NARIC. Should I still go through the red route or can I just ask for "NARIC’s English Language Assessment" individually?
