Tier 2 Redundancy & Change employer

Post by Redpoltergeist » Thu May 17, 2018 4:10 pm

Hi ,

I have been granted Tier 2 general visa in 2016 and I had received an RCOS where I had to go to my home country and apply for entry clearance.

My company is currently thinking of redundancy,
1) I wanted to check if I can look for new employers who can sponsor me
2) Will my new employer have to be applying for a RCOS or a UCOS ?
3) will my job be subjected to a RLMT and then I will be issued an COS
4) let's say I have agreed redundancy how long will my visa be valid (I have a 3-month statutory notice and we are currently on a 1 month consultation period).

Looking forward to hearing from you.

1. Yes you can.

2. UCoS

3. Likely yes unless you are on the shortage occupation list.

4. Depends how long HO take to send out curtailment letter reducing your visa validity to 60 days. Your sponsor only informs HO after you have left employment which triggers the letter (recent posts suggest they are being sent out really quickly now).

thanks for quick response.

So all the people complaining of not getting COS allocated is that for a RCOS or a UCOS.

how easy or difficult is it to get a UCOS as you have suggested I will be able to get UCOS rather than a RCOS.

I hope there is not much competition in allocation for UCOS

For RCoS for Tier 2 General applications outside the UK.

If the sponsor has enough in their allocation, they can assign one immediately. It is a different process for UCoS within the UK than for RCoS outside the UK.
