Sole responsibility Tier 4 child dependant visa

Hello,
I am a single mum, i have been responsible for my sons upbringing since birth. His father never make any contribution to his welfare nor has he been in contact. He is 3years old. I want to apply for tier 4 visa alongside with him as my depentant.

But the immigration rule paragraph 319h(f) says both parent must lawfully be in uk except some few exceptions

1.My question is document needed
1. Do i need to submit court lettet for sole responsibility?
2. Do i need a consent letter ffrom the father
3. If i canot get the consent letter is the court letter enough as evidence to claim sole responsibility
4.Or do i fall under compelling reasons for the application not to be refused.


Please i need advice. Thanks

You need evidence of the sole responsibility in order to show that you meet that exception. Neither the immigration rules not the policy guidance nor the modernised guidance for caseworkers specify any particular documents. So it is open for you to provide whatever evidence is available.

This is a very vague exception. It seems it would be easier and clearer to show sole responsibility.
