Son and Mother returning to UK

Post by koostang » Thu May 01, 2008 2:24 pm

Hi Everyone
Ive been trying to find some answers to the many questions I have regarding my ex-wife and son returning to the UK. She lived in the UK for 8 years and during that time was married to me for 5 years. She had her ILR. We then went to live in Japan, where we were together for 5 years and my son was born. We returned to UK every year for a month to keep her IRL in check. I returned to UK last summer after we separated (we're divorced in Japan but not in UK.) We agreed that she would come back to the UK so I could be with my son, and that time is now approaching. Is her ILR still valid? I did hear the rules have changed recently, regarding the 2 year rule. She hasn't been back to UK for 18 months. Will she have any trouble returning to this country? My son should will have his British passport, is this enough? Will she and/or my son be entitled to any benefits?
Thanks in advance for any replies.
