Tier 1 £200000 refused

Post by Riyadh Aziz » Sat Jun 16, 2018 10:49 am

Hi
My application for extension my VISA is refused because:
1- Application is engaged in business...
the evidence i sent :
Companies house certificate of incorporation
C.H. Beta copy
2 C.H. companies ACT2006 letters
C.H AR01
C.H CS01
C.H CH01
H.O says, this dose not meet the requirements , as you have not provided a printout of the current appointment report from C.H. dated no earlier than 3 months listed you as a director of the company and confirming the date of your appointment.
by the way i am a director of the company before i applied for my first Tier 1 visa.
2- creation of jobs.
H.O says, i created two part time jobs, and one was for 11 months not for 12 but add hours for same job from another employee.
yes this is true , but the total hours covers two full time jobs.

I used over £300000 to set this manufacturing company, and spent all the money and time to buy equipment, now we are staring manufacturing and marketing.now we can employ more .

I am looking for advice, what can I do now, Administration review ? and if refused again.
Thank you

Riyadh

Hi Riyadh,

Sorry to hear about your refusal.
However, it seems you missed:

1) to send the required documents. - CAR (Current appointment report) in this case. It is given in the policy guidance.

Ref: https://assets.publishing.service.gov.u ... 042018.pdf

and search for 'Current appointment report'.

2) to make the two part time jobs for 12 months each.

for the 2nd point, could you please share more information, like dates? and also if you can share how you filled the job tables in the form?

What is the date on refusal letter?

1-Current appointment report is a very specific documents which must be download from old companies house old Webcheck service: http://wck2.companieshouse.gov.uk//wcfr ... ompanyInfo

2- You cannot rely on total hours worked if you entered the route Post April 2014

Without correct documents and satisfying the requirements you cannot get extension

Sorry to hear about this.
CH Beta Copies- Did these include your filing history pages and the date of your appointment as director? This information is available on the Beta Site but on two separate pages/tabs.

1) You cannot include new docs in AR and its easy to sort this issue during fresh application as Zimba already sent you the link to get it.

2) Please share all the submitted durations of Employees. If you cant fulfill required Job creation with those employees then there is only one way to include the employees worked during your extension application process and that to the discretion of Home Office during Fresh Application. Will wait for the info from you so that we can help you.

I can understand your pain but requirements need to fulfill and HO is strict on this

Hi, Thank you for every one, the reasons for jobs creation are:
the evidence I supplied are:
full payment submissions
P60 for employees (A) and (S)
copies of wage slips for A and S
copies of IDs for A&S
Contracts for A&S
P45 for A

the decision:
the evidence you have provided is not sufficient because you have only evidenced two part time jobs, for job 1 Accountant was combined A and S from 1 Oct 2014 to 30 March 2016.while job existed for at lest 12 months, the combined hours not equal to 30 or more hours work a week for any month. you claimed job 2 Administrator , was claimed for S from 1 April 2016 to 30 Nov. 2016 ( it is wrong to 30 Nov 2017). the job lasted for at least 12 months but never exceeded the 30 hours of work a week.
in total this means you have not created 2 full time jobs .

What i submitted :
job 1 Accountant
A, 1 Oct 2014 to 4 Sept. 2015 ( 11 months ) 78 H/M
S, 1 Sep. 2015 to 30 March 2016 ( 7 months)(104 H/M)
job 2 Admin
S 1 April 2016 to 30 Nov 2017 (20 months ) 104 H/M

I am looking to your kind help and let me know how to sort it, i will apply for AR and i think the decision be negative, apply again ? how can create jobs in short time? if again negative what can i do.
i formed an industrial company and have products ! how can i close it and go back ?

Appreciate for all your replays
regards
Riyadh

This is so far away from the requirements :!: :!:

Were you not aware of the need to create two full time jobs ? How did you expect this to meet the requirement ?

Yes, any AR will be rejected.

Have the employees been continuing to work ?

Are you post or pre April 2014 ?

After you applied, did you maintain employees or take on any new ones? If so, what are their working hours per week?

Now how can sort this problem
I vannot close or leave the company.
Many costly products are there.

The rules are very clear. You must have created TWO full time jobs that last for 12 months each. You only created two part time jobs it seems. You cannot extend without satisfying the job creation requirement

Unfortunately, you did not read and understand the roles.
So, you are in a very tough situation.
There are very very limited things you can do.
Any AR application will be rejected but applying for AR will give you some time because it will give you at least 1 month before the final rejection.
If you hire one more person, T, for that period then you could submit a new application within 14 days after you get the rejection with the following:

Job 1 Accountant1
To be combined with Job 2
A, 1 Oct 2014 to 4 Sept. 2015 ( 11 months ) 78 H/M
T, June to July 2018 (1 month)

Job 2 Accountant2
To be combined with Job 1
S, 1 Sep. 2015 to 30 March 2016 ( 7 months)(104 H/M)
S, 1 Apr 2018 to 31 August 2018 (5 months) - this is assuming your rejection will only come in August.

job 3 Admin1
To be combined with Job 4
S 1 April 2016 to 31 Mar 2017 (12 months ) 104 H/M

job 4 Admin2
To be combined with Job 3
S 1 April 2017 to 31 Mar 2018 (12 months ) 104 H/M

That is the only possibility I can think of but it is so made up that it is highly likely it will be rejected.

This depends on two things:

1) Hiring someone almost immediately
2) Being able to justify why the same employee is in three different jobs - which is a very tough one to justify.
