Tie1 1 Extension and Settlement

Dear Gurus/experts

This is my friend's case.
In the extension, HO issued 3 years visa (instead of 2 years)
His solicitor said that this would not make any issue and my friend could enjoy it.
And he has crossed the border 3 or 4 times with that VISA.

1. staying in 3rd year is illegal ?
2. HO will consider this point when he applies for settlement ?
3. At the end of years, he can complete 10 years. Can he apply for settlement under 10 years ?

One more question, premium service is not available for settlement ? (After 5 years under Tier 1 Ent)
