Parent or partner route?

Pardon if I put this in the wrong area but I think this is the right place. Anyways I’ve contacted a lawyer and the UK visa service and they both say something different!

My partner and I are not married and have not lived together for two years, but we have a child together. My lawyer claims that I’m not eligible to apply for parent of a British child because me and my partner are together ( and will live together if given the visa). The UK visa hotline representive said that the guidelines ONLY mean that if you can apply for partner You need to and that I do qualify for parent since we can’t.

So which is it? I would like to get my application done and submitted ASAP but I’m getting told so many different things, I don’t even know which one to apply for! Thanks.

Partner route.

Parent route is for people who are no longer in a relationship with the child's other parent.
