EEA Unmarried Partner - Pre-Settled Status

Post by kovacsma » Sat Jun 23, 2018 1:53 pm

Recently concluded the whole residence card application for my unmarried partner -- what a saga...

Reviewing the pre-settled and settled status information available recently -- I get only a slight hint that unmarried partner's will qualify; and I can't tell if it will be easier because we have already received the residence card for her, or if there will be a whole new nightmare to go through.

Any ideas?

Unmarried partners should qualify:
https://assets.publishing.service.gov.u ... e_2018.pdf
Section 6.5 (page 24)

The information on page 25 suggests that having a residence card should make matters easier, as this can be used as a proof of an existing relationship. However, you will still have to prove that you are still together when you apply for pre-settled status (page 27). This is similar to what you would have to do if applying for PR.

Interesting. Thanks

While my route may be as easy as using a smartphone app, will it likely be that easy for her case too? Or will we have to compile another massive folio of evidence, submit documents, and wait up to 6 months for a decision, given that (as you've cited) a caseworker has to weigh some evidence that our relationship persists?

Is your partner from the EU?, as applicants from outside the UK as i understand it will still need to apply for PR under the current system ie no online applications, and the current long winded form

Not talking PR - - not in the UK long enough to talk PR. Talking pre-settled status. According to the document first linked, it seems this is supposed to be doable under the online system, with a reasonably quick answer - - but I suppose the question is if this is how it will practically work out.

The statement of intent mentions uploading/sending supporting documents so i doubt it is going to be as easy as they are making out (at least for non eea citizens), but emailing/uploading them might be easier than posting the massive form, we will have to see
